Marek Tatała for 300: Now is the Time for Work – The Most Important Challenges for the New Government
"It is good if the new governing coalition turns towards appreciating working people, in contrast to Law and Justice, which heavily focused on increasing transfers to economically inactive individuals, including retirees. Yes – the prosperity of people and the country largely stems from work, and it is important for labor productivity to continue to grow (and with it, not detached from it, wages), and for the working period to extend, as the lifespan and professional activity of people living in Poland have been increasing for years," writes Marek Tatała, an economist and vice-president of the Economic Freedom Foundation, which runs the TerazPraca.org.pl project, in his text for 300POLITYKA. *** In the discussion about the composition of the new government, the ministry responsible for labor has generated insufficient media excitement. This does not mean that this topic will not be of great importance in the coming years. On the contrary, the future government will have to respond to several serious challenges related to the necessity of further increasing professional activity, a migration policy geared towards labor market needs, or adapting education and training to technological changes. Agnieszka Dziemianowicz-Bąk has become the new minister, and the word 'labor' itself is set to return to the ministry's name. It would be valuable for the ministry's leadership to consider the following data and facts when planning public policies. Increasing Professional Activity The employment rate in Poland has been growing in recent years and reached 76.7% by the end of 2022, slightly above the EU average. This is positive, but at the same time, we still have significant reserves to utilize due to demographic changes and a declining number of people of working age. For example, the activity rate for individuals aged 55 and over is only 56.4%, compared to the EU average of 62.3% and over 73% in Germany or almost 74% in Estonia. Economic policy should create favorable conditions for even more people of working age to be professionally active. A Good Migration Policy Besides increasing labor market activity, migration will be an important factor in mitigating tensions related to demographic changes. According to ZUS (Social Insurance Institution), "for the demographic burden ratio [i.e., the ratio of the number of people of retirement age to the number of people of working age – author's note] to remain at its current level in the coming years, the number of foreigners of working age would need to increase by 200-400 thousand annually." This is several times more than what we have observed in recent years and would mean that by 2032, the number of foreigners in Poland would have to reach 2.8 million people. One of the new government's tasks will be to prepare a comprehensive migration policy. Leveraging the Potential of New Technologies Robotics and automation, as well as the development of artificial intelligence, are important phenomena in the labor market and one of the topics addressed by the Economic Freedom Foundation as part of the "Teraz Praca" (Now Work) project. While fears of mass technological unemployment are exaggerated, this trend will affect the demand for specific qualifications. Previous technological breakthroughs (related, for example, to the advent of the steam engine, computers, or the internet) have transformed the labor market. Therefore, the state should take this fact into account and pursue policies that allow for the utilization of new technology's potential, rather than hindering its development. Simultaneously, the education, science, and vocational training systems should more closely consider the competencies required for the future labor market. Increasing Labor Productivity The topic of work appears several times in the coalition agreement, albeit at a very general level. Perhaps this is a good thing, as we won't find the loud slogans of some parties advocating for a rapid, top-down reduction in working hours in Poland, disregarding the consequences for the economy, companies, and the workers themselves. As the economy develops, people can work less, and economic growth, rather than regulations, is the most effective way to work less. Comparative data from many countries show that the number of working hours is linked to productivity, and in Poland, it is still lower than in wealthier Western countries. Tax Changes The new coalition partners declare "reducing tax burdens imposed on workers." This is a directionally correct postulate, as the taxation of labor, which is de facto a form of penalty for professional activity, is much more harmful than other types of taxes, such as consumption taxes. Of course, such a declaration raises questions about the room within public finances, and perhaps the realization of this postulate will have to wait until an audit and the restoration of finances by the new majority. The cost of paying sick leave from the first day by ZUS, instead of employers, will also be generated, but the change would certainly be an simplification for companies. At the same time, if such changes were to come into effect, the state's role should be to ensure that sick leave is not abused. Fewer Regulations The National Labour Inspectorate is to be subsidized. However, it is important to distinguish between effective enforcement of the law and excessive repressiveness towards entrepreneurs. Furthermore, focusing on more effective law enforcement should be combined with halting the creation of new regulations. Both in the area of labor and in many other areas of state functioning, there are strong tendencies to create ever-newer provisions, even though existing laws are not yet properly applied. New Solutions for Agriculture and Housing The coalition agreement also includes two points that, while not directly related to work, are significant for labor productivity and professional activity. These concern agriculture and housing. In the former area, it is important that measures do not artificially encourage people who could move to more productive sectors of the economy to remain in agriculture. Poland already has a problem with an excessive number of people working in agriculture compared to other EU economies. According to a report on the future of the Polish economy by McKinsey & Company, "If Poland had the same productivity per hectare and per person as Germany, then 1.2 million people working in agriculture could take jobs in other sectors of the economy, and despite this, the value of agricultural production would increase by over 40%." In turn, housing availability is important for internal migration, as many of the most productive jobs are created in cities. Here, instead of further policies increasing demand for housing (e.g., various subsidized forms of loans), an increase in housing supply is needed. In other words, more housing must be built where people want to live and migrate to – the private sector plays a key role here, which cannot be replaced by various state housing programs. Work is Important for Prosperity The topic of work did not occupy much space in the expose itself. Prime Minister Tusk, besides introducing the new head of the labor ministry, recalled several well-known postulates such as "babciowe" (a benefit for grandmothers). The program is based on the sound diagnosis that the professional activity of mothers of young children in Poland is still too low, but the choice of tool raises doubts. At the same time, it is worth remembering that active mothers need, among other things, more flexible labor law. As Prime Minister Tusk said in his expose, "Polish women and men who work must have proof that the state respects their effort above all, that people who work hard will truly know that it makes sense, that it is a matter of their chance for prosperity, but also a matter of dignity." First President of the Supreme Court to Hołownia: Any requests to assign a case to a specific Supreme Court panel constitute an inadmissible attempt to influence the choice of judges

- All correspondence directed to the Supreme Court is processed by the Registry Office, which is the organizational unit responsible for the registration and distribution of incoming correspondence. The registration of correspondence ensures, among other things, the recording of the order in which cases are received by the Supreme Court, which determines the order of their consideration and the assignment of rapporteur judges. Any actions aimed at "circumventing" registration procedures that ensure the transparency of the Supreme Court's operations should be considered patently inadmissible - wrote the First President of the Supreme Court, Małgorzata Manowska, in a statement in connection with the Sejm Marshal's remarks.

"The principles of case allocation in the Supreme Court are defined by the provisions of the Supreme Court's Regulations. Any requests to assign a case to a specific Supreme Court panel constitute an inadmissible attempt to influence the choice of judges who meet certain expectations.

The appeals against the decisions of the Sejm Marshal filed by Mariusz Kamiński and Maciej Wąsik were directed to the Chamber of Extraordinary Control and Public Affairs of the Supreme Court. It is the party submitting the procedural document that determines the court to which the document is addressed (Article 126 § 1 point 1 in conjunction with Article 13 § 2 of the Code of Civil Procedure). No provision of law provides for the competence of the entity submitting the appeal (in this case, the Sejm Marshal) to direct this document to another recipient, including another chamber of the Supreme Court, or to another court. Even less does any provision of law provide for directing a letter to the President of the Supreme Court chosen by the Sejm Marshal, so that – contrary to the law – they would assign the case for consideration in a specific chamber of the Supreme Court or by a chosen panel of the Supreme Court. One must not forget that the Supreme Court reviews the legality of the Sejm Marshal's decision stating the expiration of a Member of Parliament's mandate, and therefore it is difficult to imagine that the interested party, the Marshal himself, could freely decide which body should conduct this review. Similarly, a plaintiff seeking a divorce cannot demand that their case be heard by the labor division of the district court where their acquaintance, a judge, works, even if they consider this division to be more impartial than the family division.

The division of competences between the chambers of the Supreme Court is defined by the Act on the Supreme Court. It is the presidents of the Supreme Court chambers who are obliged to ensure that cases are heard in the appropriate chambers. If the author of the appeal directs it to the wrong chamber, the president should transfer the case to the appropriate chamber. Any disputes, if two chambers consider themselves competent or no chamber considers itself competent, are resolved by the First President of the Supreme Court. A positive dispute regarding the appeal of Mariusz Kamiński was resolved on January 4, 2024, in favor of the Chamber of Extraordinary Control and Public Affairs. If the president fails to fulfill this obligation, the judicial panel to which the case has been assigned should also oversee the consideration of the case by the competent chamber. With regard to the appeal of Maciej Wąsik, the Supreme Court, in the Chamber of Labour and Social Insurance, after conducting a formal review, deemed itself incompetent and transferred the appeal to the Chamber of Extraordinary Control and Public Affairs.

In accordance with procedural regulations, the decision to resolve the appeals by the Supreme Court will be officially communicated to the Sejm Marshal. It is inadmissible for the Sejm Marshal to demand explanations from any President of the Supreme Court.

It should be noted that the provisions of law do not provide for an obligation to inform the Sejm Marshal about which chamber will consider the appeal against the decision of mandate expiration.

Ultimately, therefore, one must agree with the Marshal that his actions and expectations clearly formulated towards the Supreme Court are an absolutely unprecedented situation.

The Marshal's position regarding the need to order the situation in the judiciary should also be shared, as the existing conflict in the Supreme Court significantly hinders the performance of duties arising from statutory provisions to the detriment of citizens, the state, and the judiciary itself. However, this can only happen through appropriate changes in the laws. As I have repeatedly emphasized, I am ready for constructive discussions on this matter.

- I have just signed letters addressed to Ursula von der Leyen, President of the European Commission, and Alexander De Croo, who currently chairs the Belgian presidency of the European Union, confirming that Poland is joining the European Public Prosecutor's Office. [...]. This accession to the European Public Prosecutor's Office is the result of a process that has taken place over the past few weeks. Perhaps some of you recall that on my first day in office, I announced that I would submit such a request to the Prime Minister. Subsequently, a Council of Ministers meeting took place, and the Council of Ministers authorized the Minister of Justice to submit these notification documents. Two parliamentary committee meetings then followed [...] all required approvals have been obtained - said Adam Bodnar at a press conference. - What is important is that accession to the European Public Prosecutor's Office stems from the enhanced cooperation mechanism. This is a mechanism whereby a state joins as a result of government action, and no legislative changes are required. In other words, enhanced cooperation means that if there is a declaration from the government that we wish to participate in this instrument, then the appropriate procedure simply needs to be carried out, which is what we have now brought to completion - he continued. - The European Commission has four months to acknowledge the notification or, if necessary, raise objections. We are in constant working contact with the European Commission, and I believe there will be no objections - he added.

- The problems began in 2017, when there was an attack on the rule of law standards in Poland. First, an attack on the Supreme Court, then on the National Council of the Judiciary, and later we reaped the consequences because we have issues concerning nominations made by the KRS in its new composition formed after 2018, or due to judges appointed by the KRS presiding. This subsequently translated into numerous rulings by the Court of Justice of the European Union and the European Court of Human Rights, rulings that have never been fully implemented - Adam Bodnar said at a press conference. - One of the most recent and absolutely fundamental rulings is the CJEU's decision from December 21 last year, which concerned judges presiding in the Chamber of Extraordinary Control and Public Affairs of the Supreme Court. We are not hearing declarations that this ruling will be implemented and that all participants in public life will engage with it; instead, we constantly hear notes of doubt, questioning, and the use of various means to undermine the credibility of what the CJEU has said. My goal and responsibility is to confront this - he continued. - This situation [concerning Mariusz Kamiński and Maciej Wąsik] clearly shows that we must move forward in resolving the issue concerning both the KRS and the Supreme Court, as well as the status of judges appointed by the KRS in recent years. Because if we do not resolve this, we will have every subsequent case that could be challenged in this way, or that could produce effects that are difficult for citizens to understand - he continued.
