Polish Food Exports Reach Record Highs
According to data on Polish foreign trade in agricultural and food products, 2022 saw a record increase in the value of Polish exports, which reached EUR 47.6 billion (PLN 223 billion). This is a 26.7% increase compared to the previous year! It is worth noting that approximately 80% of the revenue generated from food exports to the European Union was from sales to Eurozone countries, according to data from Polskanatle.pl. - indicate data from the Polskanatle.pl service. We primarily sold to EU countries: poultry and beef, dairy products, bread and bakery products, animal feed, and also chocolate products. Germany remained our main trading partner, and in 2022, the value of exports to this country amounted to EUR 11.9 billion, a 25% increase compared to 2021. Domestic food products also enjoy interest in non-EU countries. In 2022, their value amounted to EUR 12.3 billion. The most significant recipients were: the United Kingdom (mainly export of poultry, meat preparations, chocolate), Ukraine (cheeses, curd cheeses, animal feed, coffee) and the United States (fish and fish preparations, pork). Regarding data for the European Union, according to European Commission data from 2022, a total of EUR 148 billion worth of agricultural and food products were exported from January to August 2022. Outside the EU, primarily cereal preparations, wheat, and wine were sent. For example, in August 2022 alone, as many as 2 million tons of European wheat reached the Middle East and North Africa (48% of total EU wheat exports), and 1.5 million tons went to Sub-Saharan Africa (34%). In the case of wine, from the beginning of the year to the end of August 2022, 36% of exports went to North America. The most important recipients of EU products were the United Kingdom, the United States, and China. Expert Commentary: Marcin Wroński – Deputy Director General of the National Support Centre for Agriculture – states that the increase in revenue from foreign sales by domestic exporters in 2022 was influenced by rising transaction prices of agricultural and food products on the international market, which were observed after the outbreak of the armed conflict in Ukraine. Simultaneously, the tendency for the złoty to depreciate against the Euro currency supported the price competitiveness of Polish agricultural and food products, as over 80% of the revenue generated from food exports to the EU was from sales to Eurozone countries. The expert adds that the revival of the EU's HoReCa sector in the first half of 2022, recovering after the pandemic, and rising food prices in EU countries generated increased demand for competitively priced and quality food from Poland. At the same time, good export results were a consequence of the efforts of domestic entrepreneurs to diversify business relationships in EU and third-country markets, thanks to their ability to adapt their product offer to the diverse preferences of foreign consumers.   • The Constitution of the Republic of Poland does not grant the President any powers in shaping the appointments of either the Prosecutor General or the National Prosecutor. The Council of Ministers, however, bears responsibility for the actions of the prosecution service, which is a consequence of the powers vested in it by Article 146(4)(7) of the Constitution of the Republic of Poland to ensure the internal security of the state and public order. It is impermissible to grant the President of the Republic of Poland, through an ordinary statute, the authority to unilaterally (decisively) influence appointments in cases other than those explicitly listed in Article 144(3) of the Constitution of the Republic of Poland.
  • Article 14 § 1 of the Act - Law on the Prosecution Service conditions the dismissal of the National Prosecutor by the Prime Minister on the consent of the President of the Republic of Poland. Given the content of the aforementioned constitutional provisions, the act of granting or refusing consent, for its effectiveness, would have to be subject to the counter-signature of the Prime Minister. The provision is therefore burdened with a logical flaw (a loop) that prevents its correct and rational application. For the above reasons, Article 14 § 1 of the Law on the Prosecution Service, to the extent that it makes the dismissal of the National Prosecutor conditional on the President of the Republic of Poland granting consent, is contrary to the principle of proper legislation and legal certainty (Article 2 of the Constitution of the Republic of Poland).
  • Public authorities, including the Prime Minister, are authorized to directly apply the Constitution of the Republic of Poland, which is a consequence of Article 8(2) of the Constitution. Article 14 § 1 of the Law on the Prosecution Service, to the extent that it introduces the condition of obtaining the President of the Republic of Poland's consent for the effectiveness of the dismissal of the National Prosecutor by the Prime Minister, is in direct conflict with the aforementioned higher-ranking norms. For this reason, this condition should be considered non-existent (non-binding).
  • Consequently, the dismissal of the National Prosecutor, in light of Article 14 § 1 of the Law on the Prosecution Service applied to the extent not conflicting with the Constitution of the Republic of Poland, occurs as a result of the act of dismissal, carried out by the Prime Minister, at the request of the Prosecutor General.
