Wednesday's Political Agenda: Duda and Tusk Meet NATO Secretary General, Trzaskowski at AmCham, Hołownia in Białystok, Morawiecki on the Road, Senate Session Begins

At 9:00 AM, the Mayor of Warsaw, Rafał Trzaskowski, will meet with members of the American Chamber of Commerce.

At 4:30 PM in Chełm, a press conference will commence, addressing, among other things, "plans to cede Eastern Poland without a fight." Participants in the conference will include the head of the PiS parliamentary caucus, Mariusz Błaszczak, MP Tomasz Zieliński, members of the District Board, and the Mayor of Chełm, Jakub Banaszek.

Visit of the NATO Secretary General to Poland

At 10:35 AM, Prime Minister Donald Tusk will meet with Mark Rutte. The talks will focus on European security issues, the threat posed by Russia, NATO's role as a foundation for security, negotiations concerning the cessation of Russian aggression in Ukraine, and preparations for the NATO summit in The Hague. At 12:05 PM, a joint press statement by the Polish Prime Minister and the NATO Secretary General is scheduled.

At 1:00 PM in the Presidential Palace, President Andrzej Duda will meet with Mark Rutte. Subsequently, at 4:15 PM, the NATO Secretary General will deliver a lecture at the Warsaw School of Economics.

Beginning of the Senate Session

The Senate will convene on Wednesday. During the two-day session, senators will address, among other matters, an amendment to the Penal Code that expands the list of grounds for hate-motivated crimes. The agenda also includes a draft amendment to the Law on the System of Common Courts and the Law on the System of Military Courts. Its aim is to implement EU law and concerns the possibility of delegating judges to other courts.

The commencement of the Senate session is scheduled for 11:00 AM. Earlier, at 10:00 AM, a briefing by the Marshal of the Senate, Małgorzata Kidawa-Błońska, will take place.

Hołownia in Białystok and Bielsk Podlaski

At 10:30 AM, a press briefing by Szymon Hołownia is scheduled in Białystok. At 4:00 PM, an open-air meeting with residents of Bielsk Podlaski, featuring the Third Way candidate for president, will begin. At 6:30 PM, an open meeting with residents in Białystok is planned.

Morawiecki on the Road

At 10:40 AM in Kostrzyn nad Odrą, a press conference will be held by the Vice-President of PiS, Mateusz Morawiecki, and MP Władysław Dajczak. Another press conference is scheduled for 12:00 PM. Subsequently, at 5:00 PM in Rawicz, a meeting with residents will take place.

We are facing a rule of law crisis. Its source lies in the 2015-2017 reforms

– There are many issues that need to be resolved through legislation primarily, in order to address the rule of law crisis, which we are undoubtedly facing, as it has been confirmed by numerous rulings from European courts, and to repeal the effects of regulations, especially in the area of the judiciary. We are currently experiencing a truly enormous crisis of the judiciary – said Marcin Wiącek in an interview with Marcin Fijołek on Polsat News’ “Graffiti”.

– The source of this problem are the judicial reforms that were carried out in 2015, concerning the Constitutional Tribunal, because at that time three judges were elected in a manner inconsistent with the constitution, and the act amending the act on the National Council of the Judiciary from December 2017 – this was the source of the problem. Because this act created the National Council of the Judiciary […] which systemically does not guarantee the appointment of judges free from the influence of the executive and legislative branches – he indicated.

– This is typical Donald Tusk and the Civic Platform government. Instead of real actions, they engage in PR stunts like this asylum law [...] In the United States, President Trump is perhaps showing that illegal immigrants can be stopped with real actions, while the Prime Minister hopes that a PR stunt, the asylum law, will solve something – which it won't,” said Marcin Mastalerek on RMF FM.

– The President has 21 days, until April 7th, it seems, and will make a decision. I would like to remind you that this law lay in the Sejm for three months. [...] The Prime Minister suddenly remembered this law [...] because he has an inconvenient topic [...] the death of the late Barbara Skrzypek, and suddenly he invents 10 other topics,” he continued.

– I will ask the Prime Minister a question [...] why did it lie in the Sejm for three months? Is it so urgent that it lay in the Sejm for three months? [...] With laws that restrict the arrival of, among others, opposition members from Belarus, you won't stop people who, for example, murdered a Polish soldier,” he added.

– I don't know what the President will do with this law,” he concluded.

It Should Not Come into Effect.

– This [asylum] act introduces solutions that, according to the Polish constitution, could only be implemented during a state of emergency or war. The suspension of constitutional freedoms or rights, including the constitutional [...] right of foreigners to seek refugee status, is permissible under the Polish constitution solely after the introduction of an extraordinary state – said Marcin Wiącek in Polsat News’s “Graffiti.”

– It is not permissible to introduce quasi-states of emergency through laws and regulations issued on their basis. [...] This is the main objection that I have formulated regarding this act – he indicated.

As he explained: – These are the international standards to which we are a party. Modern refugee law [...] is based on the assumption that a person seeking international protection in a given country has the right to have that country consider their application. Not to be admitted and granted protection, but to have the right for the state authorities to assess their situation in an individual proceeding.

International law does not deprive state authorities of the right to, let's call it, self-defense. Sometimes arguments arise about the use of force to cross the border, or a border assault that could take place. Here, international standards are obviously not an obstacle to repelling such an attack – he continued.

– Under ordinary constitutional measures, the right to seek refugee status, like any other constitutional right, can only be limited, but not excluded. I believe that such an act should not come into effect – he stressed.

According to the law, the prosecutor can refuse, but if they refuse, they must do so in writing; nothing of the sort happened. They must inform about the possibility of appealing this decision; nothing of the sort happened – he continued.

– From a legal point of view, everything that happened during this interrogation was illegal. Even if we were to assume that the prosecution is legal, which, of course, cannot be assumed – he went on to say.

– As a former Prosecutor General with 10 years of experience, I am truly surprised that in a matter of a very simple procedural act, which is the interrogation of a witness [Barbara Skrzypek], so many irregularities committed by those conducting this act can be found – he stated.

It is clear to any reasonable and empathetic person that she should have had a representative.

– Prosecutor Wrzosek, contrary to Polish law, did not allow the witness's representative to participate in the proceeding. Because it is true that a witness has the right to appoint a representative, and it is also true that a procedural body, in this case a prosecutor, has the right to make a negative decision regarding the admission of such a representative in justified cases specified by law – said Zbigniew Ziobro at a press conference.

– But this is not an arbitrary decision by the prosecutor, as emphasized by both case law and the science of procedural and criminal law. Specific situations are indicated which fully justify the witness's legal interest in having a representative appear in this process. In this case [the interrogation of Barbara Skrzypek], there are at least several such premises – he argued.

As he indicated, for example: – The health condition of the person being interrogated. If there was a reported health problem, feeling unwell, significant nervousness, and a vision problem for the late Barbara Skrzypek, then it is clear to any reasonable person with elementary sensitivity and empathy that a witness in such a health condition, who also cannot read the minutes themselves, has the right to have someone present who will ensure certainty and credibility that what is in the minutes reflects what was said.

In the world of all these "morning-after" pills, in the modern world, this is one case, it's a borderline question. It's not something that happens every day on the streets – stated Sławomir Mentzen on Kanał Zero.

– Perpetrators of crimes, rapists, must be punished very severely. Everything must be done to minimize these rapes. For example, by closing borders, because when borders are opened to people from other countries, from Africa, from the Middle East, the number of rapes drastically increases – he continued.

As he went on: – Harsh treatment of perpetrators of real rapes, not fabricated ones. Because we also have the problem that sometimes men are accused of rape that simply did not happen. This is also a serious problem, to distinguish one from the other. However, if we are sure that rape actually occurred, the punishment should be severe. But for the rapist, not for the victim.

I am deeply convinced that innocent children must not be killed, even if this child is associated with some unpleasantness. We do not have the right to kill another human being simply because this person causes us grief, is unpleasant to us, or could greatly harm our lives. We do not kill innocent people, I believe this is very important – he assessed.
