Thursday's Political Agenda: Sienkiewicz Before the VAT Committee, PMM in Szczecin, PAD Appoints New RDS Members, Advocate General's Opinion on the KRS

From 9:00 AM, the Sejm's investigative committee on VAT fraud will be questioning the former Minister of Interior and Administration, Bartłomiej Sienkiewicz.

Prime Minister Mateusz Morawiecki will be visiting West Pomerania. At 10:00 AM, he will attend a session of the Senate of the Pomeranian Medical University in Szczecin, and at 11:00 AM, he will visit the university's Medical Simulation Centre.

At 2:00 PM, President Andrzej Duda will appoint new members to the Social Dialogue Council.

Also today, the Advocate General of the Court of Justice of the EU will issue an opinion on the preliminary questions submitted by the Supreme Court concerning, among other things, the independence of the National Council of the Judiciary. Subsequently, likely a few weeks later, a ruling will be announced by the Grand Chamber composed of 15 judges.

ECJ Advocate General: Newly Established Disciplinary Chamber of the Supreme Court Fails to Meet EU Law Requirements for Judicial Independence
In the assessment of the Advocate General, the Disciplinary Chamber of the Polish Supreme Court does not meet the requirements of independence stipulated by Union law. In particular, the National Council of the Judiciary (KRS) is an body whose task is to safeguard the independence of courts and the impartiality of judges within the meaning of the Polish Constitution, and its functions include conducting the selection of judges recommended to the President of the Republic of Poland for appointment. Therefore, to properly perform its duties, it must be free from the influence of the legislative and executive organs. Meanwhile, the manner in which the members of the KRS are appointed reveals irregularities that may threaten its independence from the legislative and executive organs - it was stated in the opinion of the ECJ Advocate General.
"The Advocate General believes that the manner of appointing KRS members involves the influence of legislative organs on the KRS and it cannot be excluded that the Sejm will choose candidates who do not have the support, or have little support, from judges, as a result of which the opinion of the judicial community may have insufficient weight in the process of selecting KRS members. Regardless of the aim of strengthening the democratic legitimacy and representativeness of the KRS, this regulation is capable of adversely affecting the independence of the KRS. Furthermore, following amendments to the Act on the KRS, changes to the method of appointing judges who are members of the KRS were accompanied by the premature termination of the terms of office of the existing KRS members. Regardless of the indicated purpose, which is to unify the terms of office in the KRS, it can be considered that the immediate replacement of the existing KRS members, linked to the new system of KRS appointments, further weakens the independence of the KRS from the legislative and executive organs. On this basis, given that judicial councils are crucial for guaranteeing the independence of the judiciary in the jurisdictions in which they are established, and that they themselves should be independent and free from the influence of the legislative and executive organs in the performance of their tasks, there are justified grounds to objectively doubt the independence of the Disciplinary Chamber in light of the role played by the legislative organs in the process of selecting the 15 judges who are members of the KRS, and the role that this body plays in the recruitment of judges who may subsequently be appointed by the President of the Republic of Poland."

Grabiec on ECJ Advocate General's Opinion: We warned that PiS's actions were like children playing with matches, unaware of the consequences

We are awaiting the final ruling of the Court of Justice of the European Union, but the opinion itself is devastating for the legal provisions adopted in this chamber by the parliamentary majority. This so-called judicial reform is proving to be a huge embarrassment and scandal. It turns out that the new method of appointing key bodies for the judicial system in Poland is inconsistent with the provisions of the constitution and the norms of EU treaties. This opinion is devastating on fundamental issues,” said PO spokesperson Jan Grabiec during a press conference in the Sejm.

The National Council of the Judiciary, instead of guarding the independence of the judiciary, is an organ of the ruling party, used to subordinate judges in Poland to the decisions of that party. The consequences of the ruling, which is to be made based on this opinion, could be dramatic for the Polish legal system. (...) If the ECJ issues a judgment consistent with this opinion, it will turn out that the appointment of all judges [appointed by the KRS] can be questioned. If these judges were appointed by an unlawful body, i.e., the KRS acting contrary to the rules, they were chosen improperly, then they are not judges today. If they are not judges, then the judgments issued by them may be challenged. We warned that what PiS is doing is like children playing with matches, unaware of the consequences of their actions,” he added.

This is another example of Zbigniew Ziobro's recent embarrassment. Ziobro, if he had a shred of honor, would resign. We have a decision concerning the Supreme Court and retirement age. PiS withdrew from this change, but Minister Ziobro strongly justified it. We now have information concerning the National Council of Ziobro's Judiciary, meaning that the KRS was not elected in accordance with the principles of the Polish constitution. And we have an opinion regarding the Penal Code,” said the leader of Nowoczesna, Katarzyna Lubnauer.
