They didn't create interpretations; they said: I apply the provision literally, the law says this, and I am the 'mouthpiece of the law.' It's hard to be punished for literal application of a provision. The question is whether judges can today use such formal means, interpret the law in such a way as to extract the maximum decent meaning from it. And there is EU law, which provides many starting points for this.
