Żurek on the Details of the So-Called Rule of Law Act:

Three Categories of Judges.

Mateusz Nowak

- This first act, the rule of law act, is intended to restore the citizen's faith that an independent, impartial judge sits at the judge's bench, but not only faith, but also a legal assessment of the judge's appointment. The aim is that we should have no doubt that the person who steps up to the judge's bench has been appointed correctly - said Waldemar Żurek at a press conference.

- It [the act] defines three categories of judges in common courts. The first category is the young judges; they are confirmed in a certain way ex lege. The second category comprises individuals who have been legally appointed judges at least once but have been promoted to higher positions. The third category includes those who have never been appointed through a legal procedure, before the legal National Council of the Judiciary and the President - he continued.

- This act also addresses issues related to the Chamber of Extraordinary Control and Public Affairs, which it abolishes; the extraordinary appeal is also eliminated by this act - he went on to say.

- All these political fears that rulings issued in common courts by neo-judges will be thrown in the bin are untrue. This act stipulates that these rulings remain in force. However, regarding some competitions, this does not apply to the group of over a thousand young judges, but the competitions for these two remaining groups will have to be repeated before a legal body - he added.
