Tuesday's Political Agenda: Tusk at Senate Debate, Government on Second Pension Indexation, Kaczyński's Speech, Finnish President's Visit, Constitutional Tribunal Commission

At 10:00 AM, the Sejm's Justice and Human Rights Committee is scheduled to review the Senate's amendments to the law on the Constitutional Tribunal (TK) along with its implementing provisions. This is a necessary step for the Sejm to vote on the upper house's amendments during its plenary session. The plenary session – the first after the summer break – begins tomorrow. According to information on the Sejm's website, the agenda “may be supplemented” with the aforementioned amendments.

At 11:30 AM, a speech by the Law and Justice (PiS) party leader, Jarosław Kaczyński, is planned in Warsaw.

At 12:00 PM, the government will consider a draft bill realizing the Prime Minister's announcement from his exposé. This concerns the introduction of an additional indexation of pensions and annuities, alongside the existing regulations for annual indexation carried out from March 1st, in cases where the increase in consumer prices of goods and services in the first half of the given year exceeds 5%.

At 12:00 PM, Sejm Marshal Szymon Hołownia will participate in a ceremony marking the 10th anniversary of the Garden of the Righteous.

At 2:58 PM, President Andrzej Duda will meet with the President of Finland, Alexander Stubb, at the Presidential Palace in Warsaw. At 3:30 PM, plenary talks will be held under the presidents' chairmanship, and at 4:00 PM – a meeting of the presidents with the media. Earlier, at 10:15 AM, Marshal Szymon Hołownia will meet with the President of Finland.

At 4:00 PM, Senate Marshal Małgorzata Kidawa-Błońska, along with Sejm Marshal Szymon Hołownia and Prime Minister Donald Tusk, will participate in a meeting titled “Ways out of the Constitutional Crisis.” Experts and constitutionalists will be present at the meeting, including, among others, Prof. Leszek Garlicki, Prof. Irena Lipowicz, Prof. Ewa Łętowska, Judge Jerzy Stępień, Prof. Adam Strzembosz, and Prof. Andrzej Zoll.

- I believe that the Prime Minister claims he withdrew the counter-signature, but it was not withdrawn because there is no legal possibility to do so. I could just as well withdraw my signatures as the Masovian or Łódź Voivode, according to my own discretion. Of course, there is a possibility in law to correct an obvious mistake, and then there is an appropriate correction, but the signature was made. I assume that this also applies to the electronic systems that are currently in use in the Chancellery of the Prime Minister, so there is no such possibility - stated Tobiasz Bocheński in 'Sygnały dnia' on PR1.

As part of the monthly observances of the Smolensk disaster organized by PiS, Jarosław Kaczyński laid a wreath at the monument to the victims of the catastrophe in Piłsudski Square in Warsaw, and then delivered a speech. In the background, the shouts of his opponents could be heard, chanting various slogans, including "you will be imprisoned."

"We are here so that you can see up close how this has been looking for many months, since the transfer of power to the coalition of December 13th. […] Those who are disruptive have the right to demonstrate, but they must be at least 100 meters away. The police used to fulfill this obligation, today they do not. They pretend that nothing is happening. Individual police officers sometimes react […], but those who command clearly have different orders," said the PiS leader.

He assessed: "This is yet another proof of brazen, unheard-of lawbreaking. Especially since the aggression, which can be described briefly as: this is, ladies and gentlemen, Putin-esque. What is on this inscription, which they place here every month, is nothing but a defense of Putin. It is something that is untrue, and it is an untruth that was already established in the investigation conducted by the Military Prosecutor's Office."

Kaczyński was referring to individuals who leave a wreath with a plaque every month at the monument, stating: "in memory of the 95 victims of Lech Kaczyński."

"Those who come here should be and will be the subject of interest of the special services. Those truly Polish and truly Polish courts, honest courts, will judge them one day," he stated.

And therefore, today we would like [...] to hear from you what to do, how to proceed, how to move forward in a situation where the terms of three judges of the Constitutional Tribunal and one substitute judge expire in the coming months. How should we proceed: acknowledge the tribunal and inject fresh blood into it [...] or perhaps decide that this tribunal in its current form should expire, so that it can be rebuilt from scratch later - the Marshal of the Sejm continued. - For intellectual honesty, we should put all options on the table before we responsibly decide to choose one of them - he added.

- I was not satisfied with the verdict concerning the jurisdictional issues between the president and the prime minister during the infamous "chair conflict" in Brussels. - The Assembly of Judges of the Civil Chamber of the Supreme Court is taking place today. […] Yesterday, we heard a statement from a Supreme Court representative who unequivocally stated that the presidential decision had been issued, counter-signed, published, and had legal effects. This is the Supreme Court's position today, which was realized through the holding of this assembly - President Andrzej Duda said at a press conference with the Prime Minister of Finland. - We also heard statements from lawyers who are unequivocally associated with the option favoring the Prime Minister – I am thinking of the statement by Judge Prusinowski, as well as Professor Chmaj – who unequivocally said that any annulment, withdrawal, or cancellation of the Prime Minister's counter-signature on a decision issued by the President is simply legally impossible - he continued. As the President emphasized: - Any action on the X platform in the form of an attempt to cancel this counter-signature is simply legally completely ineffective. - From the perspective of any potential complaint to an administrative court, the attempt to file which is taking place – in my opinion, this is not within the jurisdiction of an administrative court at all, because we are not dealing with any administrative act - he added.
