KO Club Has Determined Its Position on Ms. Przyłębska's Pseudo-Verdict. This Verdict Does Not Exist and is Not Binding
- We, the female and male Deputies and Senators of Civic Coalition, firmly state that the ruling of the politicized Constitutional Tribunal regarding the admissibility of abortion in cases of severe and irreversible fetal defects infringes upon the dignity of women, deprives them of equality before the law and the right to healthcare, undermines their freedom, and exposes them to inhumane treatment and torture - stated the members of the Civic Coalition parliamentary club in their declaration.
"The issuance of such a ruling in an era of a raging coronavirus pandemic should be treated as a provocation and an attack on the lives and health of Polish women and men, who have been demonstrating in defense of women's rights on the streets across the country for several days. This is also an attempt to distract attention from the government's incompetence in combating the pandemic. We further point out that individuals not legally appointed as judges cannot participate in the rulings issued by the Constitutional Tribunal. A verdict issued with the participation of unauthorized individuals is a non-existent verdict. The adjudicating panel included 'dubler judge' Mariusz Muszyński and two 'successors to dublers,' namely Justyn Piskorski (who also served as the rapporteur in the case) and Jarosław Wyrembak, individuals who were elected and appointed to previously occupied positions. These are unauthorized individuals who are not judges of the Constitutional Tribunal. Additionally, the adjudicating panel was presided over by Judge Julia Przyłębska – elected as the President of the Constitutional Tribunal in a manner inconsistent with procedures. Finally, the proceedings were marred by procedural errors. The Sejm's stance, presented at the Constitutional Tribunal by PiS MP Barbara Bartuś, was not previously adopted by the Legislative Committee.
