Taking the Oath in the Sejm Equivalent to Resigning as a Constitutional Tribunal Judge? Siwiec: Of Course, That's Nonsense

Mateusz Nowak

Marek Siwiec was asked on Radio ZET about the statement by Zbigniew Bogucki, Head of the President's Chancellery, regarding four judges of the Constitutional Tribunal. The statement mentioned a planned oath-taking in the Sejm, asserting that "ostentatious and conscious actions contrary to the law should be treated as a refusal to take the oath in the manner provided for in Article 4(1) of the Act on the Status of Judges of the Constitutional Tribunal" and that "refusal to take the oath is equivalent to resigning from the position of a judge of the Constitutional Tribunal".

- Of course, that's nonsense - said Marek Siwiec, responding to the host's statement: "The president is de facto saying: if the judges come to the Sejm, they will take the oath before a notary, they are resigning from their position as judges of the Constitutional Tribunal".

- Of course, if he wants to resolve the matter, let him invite these judges today. They will probably come, they will all be in Warsaw today, they should be invited - he continued.
