Oath of Constitutional Tribunal Judges Before Another Body? Bogucki: The President Adheres to the Law - This is a Constitutional Delict and a Serious Crime

- Article 4, paragraph 1 of the Act on the Status of Constitutional Tribunal Judges unequivocally stipulates that the oath is taken before the President of the Republic of Poland, which is what happened today. There is no other provision in the Polish legal order, no other legal basis for the oath to be taken in a different manner, and certainly not before another body - said Zbigniew Bogucki at a press conference.

- Therefore, the President warns everyone who might entertain the idea or want to materialize some insane constitutional concepts regarding the possibility of individuals elected as judges of the Constitutional Tribunal taking their oath before another body, that we would then be dealing with both a constitutional delict and a serious criminal offense - he indicated.

- It would be an action without a legal basis and beyond the limits of the law. This is absolutely obvious - he added.
