- Today, the President of the Republic of Poland, Karol Nawrocki, received the oaths of office from two individuals elected to the position of judges of the Constitutional Tribunal by the Sejm of the Republic of Poland. This concerns Ms. Magdalena Bentkowska and Mr. Dariusz Szostek - said Zbigniew Bogucki at a press conference.
- There are two principal reasons why the President today received the oaths of office from two individuals elected by the Sejm to the position of judges of the Constitutional Tribunal - indicated the Head of the Chancellery of the President.
"Two Seats Became Vacant During President Nawrocki's Term"
- Firstly, please note the chronology. The President of the Republic of Poland was sworn in on August 6, 2025, and two vacancies expired after his inauguration. This means that two vacancies in the Constitutional Tribunal became vacant during President Nawrocki's term. The President considered it his fundamental responsibility as head of state, and within the mandate he assumed from August 6th, to fill these two vacancies - he continued.
- I would like to remind you that these were vacancies that arose on December 5, 2025, and December 20, 2025 - he specified.
"Two Judges Fulfill the Requirement for a Full Constitutional Tribunal Composition - 11 Judges"
- The second reason is equally important. [...] There are currently only 9 judges in the Constitutional Tribunal. The constitutional composition of the Tribunal requires 15 judges. However, according to the current law, which is consistent with the constitution and undisputed by any political circles, the full composition of the Constitutional Tribunal consists of at least 11 judges - he pointed out.
- Therefore, if we currently have 9 judges, then the two judges who should join the ranks of the Constitutional Tribunal today, after taking their oaths, will fulfill the statutory requirement for the Constitutional Tribunal to operate in its full composition as defined by law, i.e., 11 judges - he emphasized.
