At a press conference, Adam Bodnar discussed the Ministry of Justice's plan for the so-called neo-judges, meaning judges nominated after 2018 by the National Council of the Judiciary (KRS) shaped as a result of PiS changes. As he stated, the most important element of the planned regulations is "the recognition that among the judges appointed after 2018, we have three groups."
"The Green Group"
- The first group, a sort of green group, consists of individuals who didn't really have a choice. They graduated from the National School of Judiciary and Prosecution, completed their traineeship, and had no other KRS to choose from. They underwent evaluation by the KRS and simply became judges of the Republic. […] In the case of these individuals – approximately 1600 people – the law will simply stipulate that these individuals have the status of judges appointed in accordance with the constitution, and therefore there will be no doubts later - he explained.
- However, we have a group of people who decided to pursue promotions after 2018. They decided to go to a higher court, or to become judges in a rather unclear manner, especially judges of the Supreme Court - he noted, adding that in this case, two groups will be distinguished.

- The first group comprises individuals connected by what we have termed a "common undertaking" – that they, perhaps consciously, sometimes unconsciously, sometimes recklessly, participated in building a non-democratic order in Poland, not only because they accepted promotions but also because they later held various positions within the justice system: they became court presidents, disciplinary spokespersons, heads of departments, or even sat on the Supreme Court - he said.
- This will be the goal of this project: that three months after the law comes into force, these individuals will return to their previously held positions. […] The promotion that this person owes to the post-2018 KRS will be revoked - he emphasized, specifying that this concerns 500 individuals.
At the same time, he noted: - These 500 individuals who created a non-democratic order will also be subject to disciplinary responsibility. A special body will be established to function as a collegial disciplinary spokesperson, and these individuals will be assessed from the perspective of violating the principles of judicial ethics.

In turn, the third group of judges, as Bodnar stated: - These are individuals who […] received this promotion solely because they had an unyielding desire to advance within the judicial structure. They were aware that this KRS might not be as it should be, but they decided to participate in the competition and advanced higher - he continued, adding that according to estimates, there are 900 such individuals.
- In this case, we are planning to introduce an institution, which I would call "active repentance" – meaning, if they submit a declaration and say: "Yes, indeed, this was our life's mistake," then they will voluntarily return to the court where they previously adjudicated, but nothing further will happen to them. They can start new competitions from the next day and apply to function under new rules - he informed.
