Thursday's Political Agenda: Sejm on Abortion, Border Weapons Use, Immunity, and Romanowski's Arrest; Duda Continues NATO Summit

The Sejm convenes for a two-day session. The proceedings will commence at 10:00 AM, when MPs will address – as part of the second reading – the bill submitted by Lewica regarding the partial depenalization and decriminalization of acts related to pregnancy termination.

At 12:30 PM, the second reading of the government's draft Electronic Communications Law and its implementing provisions will take place; these projects aim to implement EU law. At 2:30 PM, the second reading of the government's bill to improve the actions of the Army, Police, and Border Guard in the context of the situation on the Polish-Belarusian border is scheduled (its most significant provisions concern the rules for the use of weapons by soldiers and officers).

At 3:30 PM, the first reading of the citizens' bill "Stop Price Hikes from July," sponsored by PiS, will be held. In turn, at 5:30 PM, consideration of the National Prosecutor's request to lift the immunity of Marcin Romanowski and to detain and temporarily arrest the MP is foreseen.

The agenda may be expanded to include an MP's draft resolution on amending the Sejm's Rules of Procedure, which proposes the establishment of a Committee for Children and Youth and the reintroduction of rotational chairmanship and deputy chairmanships in the Committee on Special Services.

At 8:30 AM, the Committee on Justice and Human Rights will convene to consider the Senate's amendments to the amendment of the law on the National Council of the Judiciary. At 3:00 PM, the Committee on Rules, MP Affairs, and Immunity will consider a private prosecutor's request to lift the immunity of Mariusz Błaszczak.

At 8:30 AM, the Senate Committee on Culture and Media will address the amendment of the Copyright and Related Rights Act. The Senate will resume its proceedings at 12:00 PM, but all indications are that this amendment will not be considered during this session.

Today marks the last day of President Andrzej Duda and the First Lady's visit to the United States in connection with their participation in the NATO summit. Around 3:50 PM Polish time, the President will arrive at the Walter E. Washington Convention Center, where he will meet with the media as part of a "doorstep" session. At 4:30 PM, he will participate in a meeting of the North Atlantic Council with invited NATO Partners.

At 8:30 PM Polish time, he will participate in a meeting of the NATO-Ukraine Council at the level of heads of state and government. The closing point of the visit will be a meeting with the media at 11:00 PM.

At 1:00 PM, a press conference is scheduled with the Minister of Justice and Prosecutor General Adam Bodnar and the Minister of Justice's plenipotentiary for court experts, Prof. Tadeusz Tomaszewski. Topic: Proposals for changes to the regulations on court experts.

Also at 1:00 PM, a press conference will be held by the head of the PiS parliamentary club, Mariusz Błaszczak, Zbigniew Bogucki, and other PiS MPs.

- If someone had an increase in May [...] it could have happened because previously we had two energy prices: a limited price, just over PLN 400, and a maximum price of PLN 693. If someone, and this had been in effect for many years, if someone had exhausted their limit for the lower price, they moved to the higher price of PLN 693, and this was indeed a huge increase, in May, in June people were entering this threshold. We are lowering the maximum price; if someone actually had a price of PLN 693 in their recent settlements, their bill will be lower because the maximum price will currently be PLN 500 per megawatt-hour - said Paulina Hennig-Kloska on Radio Zet.

- The billing system was so complicated, we have significantly simplified it, and yes, there may be people whose bills will drop for July, August, and September, if they are based on actual billing - she continued.

Constitutional Tribunal judges, which may be a novelty for some, are also obliged to comply with the law in force in Poland; therefore, I will send such a notification to Prosecutor General Adam Bodnar today and I hope to receive a response in this matter - said Szymon Hołownia at a press conference. - The Constitutional Tribunal is not an organ organizing the work of the Sejm, it is not an organ standing above the laws of the Republic of Poland; it has strictly defined competences which it should implement. Meanwhile, the antics, because that is how I assess it, of judges who intend to administratively punish MPs [...] are absolutely unacceptable - he continued.

Hołownia Announces New Procedure for Selecting Constitutional Tribunal Judges

- Yesterday, at the Sejm Presidium, we discussed the new procedure for selecting candidates for Constitutional Tribunal judges for the first time. Three spots in the Constitutional Tribunal will become vacant in December, and one in April of next year. I want to propose that we no longer have a situation where, at the very end, some party nominates someone, because we have already had a politicized Constitutional Tribunal, and it didn't turn out well for us. So, this time I would like us to go in a different direction. I asked 11 organizations, from left to right, from the Jagiellonian Club to the Helsinki Foundation, to Iustitia, to Wolne Sądy (Free Courts), how they see the procedure for selecting candidates for candidates for the Constitutional Tribunal. Everyone responded, and based on that, we have prepared a certain procedure, which, with the participation of prominent figures from the legal world, as well as state officials, will present, if we agree to it, the Sejm Presidium with a group of candidates, 8 candidates, from whom the Presidium will then select 4, who will be presented to the high chamber. This in no way negates the right of 50 MPs to submit their own candidates - stated Szymon Hołownia at a press briefing in the Sejm.

- I care about the process of sanitizing the Constitutional Tribunal being conducted seriously, model-wise, exemplary, and that we truly listen to civil society in this matter, so that we have the best of the best - he added.

There was no plan whatsoever to cut the MND budget. [...] The budget of the Ministry of National Defence will be the highest in history, it will be approximately 10% higher than in 2024. It will be a record-breaking budget, higher not only in nominal terms but also in relation to GDP. KRS Act: Parliamentary Committee and Bodnar Oppose Senate Amendment on "Neo-Judges"

The Parliamentary Committee on Justice and Human Rights has voted in favor of rejecting the Senate's amendment to the amendment of the Act on the National Council of the Judiciary (KRS), which would have allowed so-called "neo-judges" to run in elections for the Council.

The bill that emerged from the Sejm stipulated that former judges appointed by the KRS functioning since 2018 would not be eligible to stand for election. The Senate struck out this provision, a move supported by, among others, Adam Bodnar. However, during the parliamentary committee session, the Minister of Justice recommended that MPs reject this amendment – which means a return to the original wording.

"The adoption of the Senate amendment, regardless of the Venice Commission's opinion, was a gesture towards the President, indicating that there would be no restriction on the right to stand for election during the appointment of the new KRS. The ruling coalition hoped that the President would not remain indifferent to the rulings of the European Court of Human Rights (ECtHR), the Court of Justice of the European Union (CJEU), and the deepening crisis each day. That he would share responsibility for the process of repairing the justice system," the Minister of Justice stated during the committee meeting.

"Unfortunately, from the President's public statements, it appears that the President does not see such a possibility," he admitted, quoting the President's doubts regarding the shortening of the KRS's term, which is provided for in the amendment being processed.

"Interestingly, the President had no such doubts when he signed the KRS Act in 2018, when we were dealing with a fully constitutionally functioning body and when there were no doubts about its independence," he noted.

"Regardless, however, of the President's stance and his future decision, it is the duty of parliamentarians to pass the legislation they deem optimal from the perspective of implementing and balancing constitutional values," he argued.

"Given the circumstances, I would nevertheless like to recommend that MPs reject this Senate amendment. My recommendation is an expression of concern and responsibility for rebuilding the rule of law in Poland, because this is a process that will take many more months, but which must take into account the comprehensive nature of the planned changes," Bodnar declared.

Filiks Appointed New Chairwoman of the Postal Ballot Investigation Committee

Magdalena Filiks has become the new chairwoman of the parliamentary investigation committee concerning postal elections. She replaces Dariusz Joński, who secured a mandate as a Member of the European Parliament.

Her candidacy was supported by 5 members, with 3 voting against and 2 abstaining.

Two new deputy chairmen were also elected: alongside Bartosz Romowicz, Karolina Pawliczak and Krzysztof Szczucki were appointed to these roles. These appointments fill the vacancies created by Waldemar Buda's election to the European Parliament and Jacek Karnowski's assumption of the position of Deputy Minister of Funds and Regional Policy.

Giertych, Tomczyk, Szczerba, and Campus Polska: PiS Files Criminal and Misdemeanor Complaints
- The first complaint, we mentioned it last week, we waited for Mr. Giertych to become active after our first conference. It turned out that even though he had notified or informed on social media, he only filed a complaint against Chairman Jarosław Kaczyński in connection with the letter published in the media last week, after our conference, when it turned out he hadn't filed it. He filed it two or three days later. We consider this to be an action that fulfills the characteristics of a crime, or may fulfill the characteristics of a crime of false accusation, or an accusation of a crime that was not committed - said Zbigniew Bogucki at a press conference. - The second complaint, we also mentioned it, it is extremely important, it concerns the functioning of Campus Polska [...]. They say so much about us improperly [...] financing the election campaign, but what is Campus Polska if not an appendage of Civic Platform, operating before the campaign, during the campaign [...]. The third complaint concerns Mr. Cezary Tomczyk. We are talking about the suspicion of committing a crime [...] the Deputy Minister spoke about "Russian trolls", referring to the Chairman, but also to the Law and Justice Parliamentary Club - he continued. - A complaint about a misdemeanor committed by Mr. Szczerba, this again refers to all these accusations against us that were formulated, that handing over a check, opening a road, showing the modernization of a hospital is a violation of the rules of financing an election campaign. - We realize that court experts, the lack of reform for this institution, is one of the causes of the crisis in the justice system, especially the lengthy court proceedings, and this reform is generally about that – stated Adam Bodnar at a press conference. - The currently binding regulations do not fulfill their tasks, because firstly, we have a lack of systemic solutions. For years, non-governmental organizations and legal circles have been calling for changes, but these changes have not occurred. These regulations are incomplete and outdated, they require ordering and especially require their definition in the context of prevailing socio-economic conditions, meaning the duties of an expert, the selection process, entry onto the list of experts, and also the lack of detailed regulations regarding the verification of experts, as well as the regulation of the situation of so-called institutional experts – he continued.

- We must restore the normal constitutional status in the functioning of the National Council of the Judiciary (KRS). These 15 judge members of the KRS should be appointed by other judges, as the constitution requires. We will see how long it takes us to achieve this situation. From my side, I will certainly not try to contribute to deepening the crisis related to these judicial nominations, defective judicial nominations, which is why I am continuing the practice of not announcing competitions for vacant judicial positions – said Adam Bodnar at a press conference.
