Tusk's surprisingly tough words after the Salzburg summit essentially pave the way for a no-deal Brexit, which would mean, for example, a lack of international guarantees for the rights of over a million Poles on the Isles, and in terms of governance, the inability for them to seek justice before the European Court of Justice. According to sources speaking to 300POLITYKA, this may well determine Donald Tusk's choice to continue his career in European political institutions, with the support of Merkel and Macron, and distances him from a return to Polish politics, as a potential "hard" Brexit would affect over a million Poles.




"Tusk's and Macron's tone and decisiveness were surprising," writes Maciej Czarnecki in the weekend edition of Gazeta Wyborcza. Czarnecki points to May's statement that "currently, it would be better for the British to have no withdrawal agreement with the Union than a bad agreement." This also means a lack of international legal backing for the interests of over a million Poles on the Isles, including approximately 60,000 companies founded there by Poles. While May assures that these rights will be respected, Maciej Czarnecki points out in GW that "she can always change her mind." Moreover, May's position is particularly fragile today, just before the crucial Tory conference in Birmingham, and in the event of her departure, she could only be replaced by an anti-immigration hawk.

Polish diplomats, former diplomats, and Brussels politicians with whom 300POLITYKA has spoken highlight that Donald Tusk's words after the Salzburg summit, stating that the economic plan negotiated around the Brexit agreement "would not work," almost unequivocally indicate his intention to continue his career in European institutions with the support of France and Germany. In their opinion, in a scenario of returning to Polish politics, Tusk would not engage in such a risky confrontation with the British, which could result in a no-treaty parting with the Union, and thus, among other things, a lack of international guarantees for the durability of Poles' rights on the Isles and securing large British contributions to the EU budget after departure, as these fall at the end of the financial perspective.

One former diplomat who worked at European summits points out to us that at such a sensitive moment, less than two weeks before the annual Conservative Party conference in Birmingham, there was an attempt to, as he puts it, "de-dramatize" the politically delicate Brexit process.

The statements by Tusk and Macron after the informal Salzburg summit strongly contrasted with Michel Barnier's words at the Bled forum in Slovenia, where he suggested that the EU might make concessions regarding the so-called "hard" Irish border and that a final agreement on the withdrawal treaty is "possible within 8 weeks." Macron's, and especially Tusk's, words after Salzburg essentially nullify these assurances from an influential EU negotiator.

Barnier's line was about investing in relations with the UK, which is why the word "unprecedented" was introduced into the language Europe used to discuss Brexit," one person closely following the negotiation process tells us. "Unprecedented" referred to the Union's relationship with the UK after Brexit and was intended to give special status to relations with the UK, differentiating them from relations with countries and organizations that had never been in the Union: Norway, Switzerland, or the EEA.

After Barnier's words in Bled, May's position stabilized, the pound rose, and exceptionally brutal British tabloids began writing that the Union was listening to Britain. May has long been under strong pressure from the right wing of her own party, especially from Boris Johnson, whom she dismissed, or politicians like former negotiator David Davis or Liam Fox. Macron's, and especially Tusk's, words "some parts of Theresa May’s Chequers agreement 'will not work' for the EU" throw May to the wolves of the party's right wing two weeks before the annual Tory conference.

One Brussels politician we spoke with tells us that after Salzburg, the Brexit process is becoming unpredictable: "This is extreme irresponsibility in its purest form." He also points to a sentiment, particularly strong in Macron's circle and among Brussels elites, that leaving the EU must be painful regardless of the consequences, because leaving the club "must cost and discourage others from following the path taken by the British."

"Tusk allowed himself to be dictated radical tones, at the expense of the interests of Poland and Poles on the Isles," adds one MEP. However, sources at 300POLITYKA also admit that Tusk, through his hard line and "adherence" to the line of Macron and Merkel, has become – alongside them – one of the EU leaders with an unquestionable position, and not utilizing it for a return to Polish politics would be a wasted opportunity to remain at the forefront of European politics.
