"For over a year and 3 months, the 13th of December coalition consciously failed to fulfill its constitutional obligation to appoint Constitutional Tribunal judges, breaking the law in order to destroy the Tribunal and paralyze its work, so that it could not effectively counteract the government's ostentatious violation of the Constitution," wrote Zbigniew Bogucki on social media.

"Today, Minister Marcin Kierwiński will announce about 'taking an oath in a different way' than before the President of the Republic of Poland, and then the police will escort individuals who have not sworn allegiance before the President into the Constitutional Tribunal," he continued, referring to the morning statement by the head of the Ministry of Interior and Administration.

"Mr. Minister Kierwiński, Article 4, paragraph 1 of the Act on the Status of Judges of the Constitutional Tribunal unequivocally stipulates that there is no legal basis for swearing an oath in any way other than before the President of the Republic of Poland. Since it is 'before,' it means in the presence of the President of the Republic, not, for example, before the Mayor of Warsaw (though you probably dreamed of that), the Marshal of the Sejm, or a notary," Bogucki pointed out.

The Head of the President's Chancellery attached a dictionary definition of the word "wobec" (before/in the presence of) to his post.

"Furthermore, this provision does not set any deadline for the President of the Republic of Poland to accept the oath. Therefore, any attempts to enforce lawlessness by force will constitute both a constitutional offense and a serious crime," he stated.

"I am informing you to cool down the heads heated by yesterday's oath-taking within the ranks of the fighting democracy, and to spare the police, law enforcement agencies, and courts work in the near future," Bogucki concluded.
