Today, in reality, two people living even in a same-sex relationship, but also heterosexual couples, can go to a notary, but unfortunately, they cannot acquire many of these various rights based even on such an agreement, and this law regulates these matters - said Katarzyna Kotula at a press conference after the government meeting.
- This conciliatory draft actually talks about everything that is everyday practice. It is a matter of regulating rights and obligations in the sphere of material matters, personal matters, as well as family matters. A civil law agreement made at a notary will be registered in the civil registry office in a sub-register. And here, analogously to the law on so-called simplified divorces, we focused on creating such a sub-register, in which these agreements would be registered at the civil registry office - she explained.

This Law Isn't Peanuts.
"In this main law, we regulate the issue of what is included in the agreement. A civil law agreement primarily includes a number of decisions. Thus, one can say that this law optionally guarantees us a certain scope of rights, and these rights include, among other things, property matters," Katarzyna Kotula said at a press conference after a government meeting.
"The parties to the agreement choose whether they want to remain in separation, which here is automatic, unlike in marriage, but they can decide on community property. If they decide on community property, they are entitled to joint tax settlement after a full tax year. [...] Joint settlement is something that cannot be obtained today through a civil law agreement," she continued.
"Another important issue is exemption from inheritance and gift tax, i.e., the so-called zero group for individuals who decide on such nearest person status in a relationship. Access to medical documentation and information - this is, of course, something the LGBT community has been talking about for years and greatly needs, but also mandates in ordinary, everyday matters, as well as before administrative courts," she pointed out.
"Of course, there is the issue of the right to use an apartment and the issue of inheritance. The issue of inheritance is regulated on the principle of testamentary succession, not statutory succession. The law introducing the regulations also addresses the issues of rights acquired under the nearest person status, which are also not possible today, and these include, among others, health insurance, family pension, and the right to burial," she listed.
As she emphasized: "This law isn't peanuts. This law realistically guarantees security, guarantees legal protection for people living in same-sex relationships, meaning we are talking about same-sex couples and hetero couples."
