Tuesday's Political Agenda: Siemoniak and Trzaskowski on Crime, PiS Youth Forum Happening, and Błaszczak's Press Conference, Government Session

At 8:00 AM in Warsaw, a press conference and happening organized by the PiS Youth Forum and Warsaw councillors will take place. The theme is: Greeting Rafał Trzaskowski at work.

At 9:30 AM, a press briefing will be held at the Ministry of Interior and Administration (MSWiA) with Tomasz Siemoniak and Rafał Trzaskowski. Earlier, the head of MSWiA and the Mayor of Warsaw will meet with services. The briefing will focus on inter-service cooperation in combating organized crime, including in Warsaw.

At 10:00 AM, a press conference will be held by the chairman of the PiS parliamentary club, Mariusz Błaszczak, and the PiS spokesperson, Rafał Bochenek.

At 12:00 PM, a government session will commence. The agenda includes a draft amendment to the Development Cooperation Act, a draft amendment to the Act on the National Science Centre, and a draft amendment to the regulation concerning the list of entities subject to protection and their respective supervisory authorities. The government will also consider a resolution on the adoption of the "Policy for the Economic Promotion of Poland".

Also at 12:00 PM, two Senate committees will consider amendments to certain acts in connection with the Republic of Poland's accession to enhanced cooperation on the European Public Prosecutor's Office, as well as the so-called incidental act – the act on specific solutions concerning the Supreme Court's handling of cases related to the elections of the President of the Republic of Poland and supplementary elections to the Senate of the Republic of Poland called for in 2025.

President Andrzej Duda is currently in the United Arab Emirates to participate in the World Governments Summit, but his schedule has not yet been published.

– A different formula has been adopted. I think the Prime Minister also had the opportunity to meet with the leader of Lewica, Włodzimierz Czarzasty. Changes were made to the Council of Ministers not so long ago, so that was also after consultations. Here, the Prime Minister’s role in coordinating these actions is, of course, the greatest – he continued, when pressed about the lack of coalition leaders' meetings.

We are currently working on the details and on appointing the members. In this notification, Adam Bodnar points to the suspicion of exceeding authority by Michał Ostrowski – said Prosecutor Przemysław Nowak at a press conference.

"A Series of Circumstances Justifying Suspicion of Committing an Offense"
– The justification points to a series of circumstances that justify this suspicion of committing a crime. These are largely circumstances consistent with [...] the circumstances that formed the basis for the decision to suspend the prosecutor from his official duties. It primarily concerned the prosecutor taking official actions contrary to current service practices and regulations – he indicated.

As he listed: – Acceptance of a notification from his colleague Bogdan Święczkowski, followed by the initiation of an investigation without adhering to any of the rigorous procedures applicable in the prosecutor's office, meaning without obtaining the decree for this case [...] and subsequently carrying out further official and procedural actions, essentially consisting solely of interrogating 9 witnesses. None of the documentation produced by Mr. Ostrowski contains any case number.

"Investigation Launched"
– This notification was forwarded today to the Internal Affairs Department of the National Public Prosecutor's Office, and today a prosecutor from this department launched an investigation into an act under Article 231 – informed the spokesperson for the National Public Prosecutor's Office.

"Suspicion of Privatization and Rigging"
As he continued: – The justification for this initiation and the description of the act are more or less identical to the notification. [...] To put it in a simplified way: there is a suspicion in the case that it involved a type of private proceeding, a type of privatization, as well as, in my opinion at least, a type of rigging between the notifying party and the person who initiated an investigation "alongside" the prosecutor's office, having an obvious environmental and private interest in initiating and conducting this investigation in such a manner.

Early Stage of Disciplinary Proceedings.

– Yesterday, Prosecutor General Adam Bodnar decided to suspend Deputy Prosecutor General, Prosecutor Michał Ostrowski, from performing his official duties – said Prosecutor Anna Adamiak at a press conference.

Bodnar Appointed a So-Called Ad Hoc Spokesperson
As she stated: – This decision was preceded by another decision, namely that Adam Bodnar – acting here as Minister of Justice – appointed a so-called ad hoc spokesperson, i.e., a spokesperson for the Minister of Justice, a prosecutor to conduct an explanatory proceeding, which is an early stage of disciplinary proceedings.

– The subject of this proceeding is to assess the actions taken by Prosecutor Michał Ostrowski in the course of carrying out the prosecutor's tasks, which, in Adam Bodnar's assessment, are contrary to current regulations – she indicated.

"He Initiated Proceedings Despite the Investigation Not Being Registered"
As she explained: – Prosecutor Michał Ostrowski initiated proceedings, an investigation based on a notification from the President of the Constitutional Tribunal, Bogdan Święczkowski, despite the fact that this investigation was not registered in the prosecutor's office's record-keeping systems. [...] He did not forward correspondence that arrived to him – it was addressed to him personally – in accordance with the principles regarding document circulation in the prosecutor's office [...] for the registration of this notification and its transfer to the appropriate prosecutor's office unit.

– This case was not assigned to any prosecutor, let alone to Prosecutor Michał Ostrowski – she added.

– Conducting proceedings, meaning undertaking procedural actions, is also conditioned by the objectivity and impartiality of the person conducting the proceedings – said prosecutor Anna Adamiak at a press conference.

As she noted: – It is common and general knowledge that prosecutor Michał Ostrowski maintains close relations with the President of the Constitutional Tribunal, Bogdan Święczkowski – for a long time, he was his direct subordinate – therefore, in this situation, grounds exist to disqualify this prosecutor from conducting the proceedings.

– Prosecutor Michał Ostrowski, having full knowledge […], that such circumstances exist, undertook procedural actions irrespective of this awareness – she added.

– The Prosecutor General deemed it necessary to prevent Prosecutor Michał Ostrowski from taking further actions, as these actions and the circumstances surrounding them violate the fundamental principles of the prosecution service's functioning as a lawful body – said Prosecutor Anna Adamiak at a press conference.

– Furthermore, they could lead public opinion to believe that the prosecution service remains a state organ serving the particular interests of certain political groups – she added.

– A resolution issued by three judges of the Supreme Court, the Criminal Chamber, which was allegedly issued […] by people who are not judges and therefore did not have the right to issue a ruling in the name of the Supreme Court, this resolution, unrecognized by the current authorities, was subsequently introduced into legal circulation by the very same judges who then on numerous occasions issued rulings in the same Supreme Court chambers, issued judgments in the same Supreme Court chambers, which were recognized by Mr. Minister Bodnar and the prosecution subordinate to him – he continued.

– There should be some elementary logic and consistency in life. If Donald Tusk and Mr. Minister Bodnar say that they are not judges, that these are not verdicts, that these are not rulings, when they are not to their liking, then they should probably be consistent. […] It is impossible to reasonably say that a given person is not a judge one day, and the next day […] is a judge – he went on to say.

– What is this, if not an assault on the fundamental principles of the functioning of the third branch of power in Poland? The most important court, the Supreme Court, the rulings of the Criminal Chamber are valid one time, and not valid another time. Surely, something like this did not even happen during the Jaruzelski era, where it was stated that some verdicts are valid, others are not, such things cannot be found even with a very in-depth analysis of jurisprudence during the hard communist period – he added.
