During the evening voting session, senators rejected the bill on postal voting proposed by PiS. For this reason, the bill returns to the Sejm, which is scheduled to address the Senate's veto on Thursday morning. Theoretically, the vote could happen earlier, for example, tomorrow during the block session, but the Senate may wait until the evening hours to formally send the resolution to the lower house. 50 senators voted 'for', 35 voted 'against', and one senator – Józef Zając – abstained.

It should also be borne in mind that in the recent elections to the Sejm of the Republic of Poland and the Senate of the Republic of Poland, a total of 234,445 voters were appointed to polling station commissions. However, in the event the draft act is enacted, electoral commissioners will have to appoint municipal polling station commissions. Although the number of these commissions is only around 2,500, comprising about 25,000 members in total, it should be considered that it would be necessary to carry out the procedure for nominating candidates, potentially drawing lots for the members or supplementing them. Subsequently, these commissions would have to constitute themselves, and then the members of these commissions would have to be trained. Completing these tasks would be impossible within two days. Since the act being processed has not been enacted and the numerous implementing acts foreseen by it, issued by several ministers and the National Electoral Commission, have not been issued, holding postal elections on May 10, 2020, is not possible. Other authorities and entities participating in the electoral procedure must also be aware of the regulations and obligations they will be required to fulfill in order to conduct the elections smoothly. These include, among others, individual ministers competent to issue specific regulations, as well as local government bodies, obliged to carry out tasks related to the organization and conduct of elections within their jurisdiction. The National Electoral Commission also points out that, in accordance with Article 7(1) of the act currently being processed in the Senate, a voter staying abroad declares their intention to vote by post to the competent consul no later than 14 days before the election day. Therefore, the deadline provided for in the draft act has passed. It is also probable that the deadline specified in this provision will pass earlier than the deadline for submitting applications to the consul for inclusion in the voters' register abroad, as stipulated in the Electoral Code. According to Article 35(2) of the Electoral Code, applications to the consul for inclusion in the voters' register can be made no later than on the 3rd day before the election day (Thursday). In view of the above, the National Electoral Commission expresses the opinion that, for the reasons stated above, it is not possible to properly prepare such an organizationally complex mechanism as the elections for the President of the Republic of Poland in order to conduct them correctly on May 10, 2020.
