Tuesday's Political Agenda: PAD Signs New Agreement with 'Solidarity,' Sejm Debates Loan Interest Subsidies, Senate Convenes, Bosak and Piebiak Hold Conferences

President Andrzej Duda will sign a new agreement with "Solidarity." A similar agreement was signed by the then-PiS candidate for president in 2015 – a move interpreted as one of the drivers of victory. A joint statement by Andrzej Duda and Piotr Duda is scheduled for 12:00.

At 11:00, the two-day session of the Senate will commence. The agenda includes only two items, one of which is the act on specific rules for conducting general elections for the president called in 2020, i.e., the so-called act on postal voting. A decision on this matter is to be made in tomorrow's voting block.

At 10:30, a press conference by Krzysztof Bosak, the Confederation candidate for president, will be held in front of the Sejm. At 11:00, a press conference with the participation of former Deputy Minister of Justice, judge Łukasz Piebiak, will take place in front of the District Court building in Warsaw. Incidentally, educational superintendencies should be abolished in the foreseeable future, as the work they do is, unfortunately, most often not suited for the 21st century – he continued.

The National Electoral Commission, in response to the letter dated May 5, 2020, informs that holding the elections for the President of the Republic of Poland on May 10, 2020, is impossible for legal and organizational reasons - wrote the head of the PKW, Sylwester Marciniak, in a letter responding to the Marshal of the Sejm, Elżbieta Witek, who had sent a letter to the commission's head asking if the PKW, as the highest electoral authority for conducting elections, was capable of organizing and holding the elections on May 10. - Only 5 days remain until the date set by Madam Marshal, and the legal status under which they would be conducted is not established. The competences of the National Electoral Commission regarding the determination of the ballot paper design and the ordering of their printing have been suspended by virtue of Article 102 of the Act of April 16, 2020, on special support instruments in connection with the spread of the SARS-CoV-2 virus (Journal of Laws, item 695), and the Act of April 6, 2020, on special rules for conducting general elections for the President of the Republic of Poland called in 2020, hereinafter referred to as the "draft act", is still being processed by the Senate of the Republic of Poland. For the efficient and reliable conduct of elections, time is essential, particularly for planning, preparing, and implementing procedures provided for in legal provisions. It should also be emphasized that the manner of conducting elections must be known in advance to all authorities and entities participating in the electoral process, as well as to electoral committees - Marciniak further writes. - Furthermore, the conditions for participation in the vote must be known to all voters. Currently, voters do not know how they will be able to cast their vote. In addition, in the event the draft act comes into force, all eligible voters should receive electoral packages and, on the day of voting, know where the specially designated ballot boxes, into which they would deposit return envelopes, are located - the head of the PKW emphasizes.
It should also be borne in mind that in the recent elections to the Sejm of the Republic of Poland and the Senate of the Republic of Poland, a total of 234,445 voters were appointed to polling station commissions. However, in the event the draft act is enacted, electoral commissioners will have to appoint municipal polling station commissions. Although the number of these commissions is only around 2,500, comprising about 25,000 members in total, it should be considered that it would be necessary to carry out the procedure for nominating candidates, potentially drawing lots for the members or supplementing them. Subsequently, these commissions would have to constitute themselves, and then the members of these commissions would have to be trained. Completing these tasks would be impossible within two days.  Since the act being processed has not been enacted and the numerous implementing acts foreseen by it, issued by several ministers and the National Electoral Commission, have not been issued, holding postal elections on May 10, 2020, is not possible.  Other authorities and entities participating in the electoral procedure must also be aware of the regulations and obligations they will be required to fulfill in order to conduct the elections smoothly. These include, among others, individual ministers competent to issue specific regulations, as well as local government bodies, obliged to carry out tasks related to the organization and conduct of elections within their jurisdiction.  The National Electoral Commission also points out that, in accordance with Article 7(1) of the act currently being processed in the Senate, a voter staying abroad declares their intention to vote by post to the competent consul no later than 14 days before the election day. Therefore, the deadline provided for in the draft act has passed. It is also probable that the deadline specified in this provision will pass earlier than the deadline for submitting applications to the consul for inclusion in the voters' register abroad, as stipulated in the Electoral Code. According to Article 35(2) of the Electoral Code, applications to the consul for inclusion in the voters' register can be made no later than on the 3rd day before the election day (Thursday).  In view of the above, the National Electoral Commission expresses the opinion that, for the reasons stated above, it is not possible to properly prepare such an organizationally complex mechanism as the elections for the President of the Republic of Poland in order to conduct them correctly on May 10, 2020.
