Monday's Political Agenda: RDS on Education, End of Strike Referendum, Constitutional Tribunal on KRS

An extraordinary meeting of the Presidium of the Social Dialogue Council will take place at 12:00 PM. The topic of the meeting will be a discussion on the situation in the education sector. A government delegation, most likely including Minister Elżbieta Rafalska and Minister Anna Zalewska, will participate in the meeting. A briefing by the Chairwoman of the RDS, Dorota Gardias, is scheduled for 1:30 PM. Also today, the strike referendum in schools and other educational institutions concludes.

At 12:00 PM, the public announcement of the ruling on the National Council of the Judiciary (KRS) Act is scheduled. In short, it concerns the Sejm's election of KRS members from among judges, as well as an appeal against the KRS resolution regarding the appointment to the office of judge. The hearing was originally scheduled for January 3rd but was canceled. The announcement of the Constitutional Tribunal's ruling was supposed to take place before the European Court of Justice (ECJ) hearing, but that also failed and was postponed.

Also at noon, President Andrzej Duda will present the Order of Polonia Restituta to Poles who saved Jews during World War II.

- The Minister of Finance is somewhat like the country's chief economist and chief accountant at the same time; these are two roles that are not easy to reconcile, but Minister [Czerwińska] is certainly fulfilling these roles very well - Prime Minister Mateusz Morawiecki said in an interview with Radio Wrocław. When asked about reports of the Finance Minister's resignation, the head of government stated that "there was nothing of the sort and it's 'of course a storm in a teacup.'" He also revealed that Czerwińska is currently on sick leave and that he is tentatively scheduled to meet with her today for "further discussions."

At noon in Katowice, Ryszard Petru will hold a press conference on collecting signatures for a citizen bill repealing the ban on Sunday trading.

We cannot feed them statements that their mission, calling, and commitment are what exhausts their volume of expectations. We are speaking clearly. A good professional also expects a salary increase. Constitutional Tribunal: Provisions on KRS Member Election Compliant with the Constitution

The Constitutional Tribunal has ruled that the provisions concerning the new method of electing judges to the National Council of the Judiciary are compliant with the fundamental law.

At the same time, the judges questioned the provisions that allowed judges to appeal to the Supreme Administrative Court against resolutions of the National Council of the Judiciary regarding appointments to office.

But now the time has come, we are at a point where, for the Polish government, the PiS government, the priority is students. We are approaching exams, and we cannot allow young people, students, children, and the youth to be exposed to stress, uncertainty, and not know what will happen in a moment when they will be taking the most important exams of their lives. It is our duty, as adults, politicians, and teachers, to do everything for these exams to take place. The government is prepared, and I can assure both parents and students today. Prepare yourselves calmly, because the exams will take place. Everything will be as planned. However, my appeal today to the teachers, and with this appeal I am coming here, is that we should understand that the priority for all of us now is students. Let's talk, adults should sit down and talk. That's what we're here for, but it cannot happen at the expense of youth and students. It cannot be associated with young people and children being exposed to stress and uncertainty - stated Beata Szydło at a briefing.

Ministry of Education: A Large Number of Schools and Institutions Did Not Participate in the Strike Referendum

- The vast majority of public kindergartens will operate without problems, and most school principals declare that exams in their schools will proceed without disruption. This is according to data provided to the Ministry of Education by the directors of these units and educational supervisors – the Ministry of Education informed in a press release.

"The data confirms that in approximately 71% of public kindergartens, 52% of primary schools, middle schools, and post-primary/secondary schools, strike referendums were not held. Considering only post-primary and secondary schools, this percentage is 62%. This means that the majority of institutions across the country will operate without problems. This is important information for parents and students who are preparing for the eighth-grade exams, middle school exams, and final matriculation exams.

Let us recall that external examinations are an important, unchanging element of the Polish education system. Thanks to them, recruitment to both higher education institutions and post-primary and secondary schools takes place, and will continue to take place, on transparent principles."

We are in the midst of talks. A break has been called at this moment because there is no agreement among the trade unions. 'Solidarność' [Solidarity], authorized representatives from 'Solidarność' to sign any potential agreements, have left the room. Consequently, a break has been called at this moment to allow for consultation on whether they will continue to participate in this meeting or not. We are ready for talks. We are ready to discuss what more we can do this year and in the coming years regarding salary increases for teachers, but also other systemic changes. The problem lies solely with the trade union centers, particularly one, namely OPZZ, but 'Solidarność' also raised it, speaking of discussions about salary increases in other sectors. Therefore, the government also wants a clear position here, whether these demands will continue to be raised, or if we will have a basis for agreement. If, after the break, there is a willingness for another round of talks, we will, of course, continue to talk here the entire time - stated Prime Minister Beata Szydło at a briefing in the RDS.

Today’s session of the Constitutional Tribunal concerning the act on the politicization of the National Council of the Judiciary will be considered invalid in the eyes of many experts due to the participation of a substitute judge in issuing the ruling. The National Council of the Judiciary, by submitting a motion to examine the act, acted for the sake of appearance. If this politicized National Council of the Judiciary had genuinely wanted to resolve legal doubts, it would have suspended its actions until the Constitutional Tribunal issued its ruling,” said Kamila Gasiuk-Pihowicz from Civic Platform-KO at a press conference in the Sejm. “The first consequence of the ruling will be the deepening of legal chaos.”

I need to be sure, and the government needs to be sure, that we are genuinely talking and that there is goodwill from the unions to avoid strikes during exams, because as I said, the priority right now is the students. We will not conduct negotiations at the expense of students. We have proposed, the government has proposed, introducing an increase for teachers from September. This is an increase that was to be another installment of the raise we have been implementing since last year, from April, and it has been accelerated. This is because it was originally planned to be introduced in January 2020. Now we are proposing, meeting the expectations of the trade unions, that it be introduced in September. We are also willing to consider the proposal made by Prime Minister Morawiecki, who said he would like to see the average salary of a certified teacher reach PLN 6,000 next year, and additionally, we have the issues raised by 'Solidarity', and here we need clarity on whether both or all three trade union centers agree on these demands, because as far as 'Solidarity' is concerned, there is still discussion about, among other things, professional advancement. This means additional funds, so there is complete ambiguity in the communication from the union side. And finally, these further demands are emerging, because it is constantly being expanded to cover the entire public sector. So today I can say this: we are open, we want to talk, to solve problems. The most important thing for us at this moment is that the students' exams take place peacefully, and I say again clearly that the government is prepared for these exams to take place, and they will take place as planned. However, to reach an agreement and to talk, we need a clear declaration from our partners, so I hope some understanding will be reached and we will be able to talk today, or we will arrange further meetings if the union side needs more time in the coming days – stated Beata Szydło at a briefing in the RDS.

It is not the role of politicians to interpret Constitutional Tribunal rulings. We acknowledge this ruling and will comply with it.

The Ministry of Health, on behalf of the entire government, has acknowledged and will comply with the ruling of the Constitutional Tribunal concerning the Act on the Prohibition of Promoting the Ideology of Homosexuality. This statement was made by the Minister of Health, Konstanty Radziwiłł, during a press conference.

The Constitutional Tribunal issued a ruling on the aforementioned act, stating that certain provisions violate the constitutional principles of equality and freedom of expression. The Tribunal's decision was based on an interpretation of the Polish Constitution, which guarantees these fundamental rights.

Minister Radziwiłł emphasized that the role of politicians is not to interpret the rulings of the Constitutional Tribunal. "We acknowledge this ruling and will comply with it," he stated, stressing that the government respects the independence of the judiciary.

The Act on the Prohibition of Promoting the Ideology of Homosexuality was passed by the Polish parliament in 2017.
