The President of the Supreme Court, Dariusz Zawistowski, has sent a letter to the European Commission, drawing attention to one of the resolutions of the National Council of the Judiciary (KRS).
The resolution in question is from November 9th, adopted by the KRS, in which the Council states that the order issued on November 5, 2018, by retired Supreme Court Justice Stanisław Zabłocki, regarding the "removal of cases from the court calendar" assigned to Supreme Court Justice Wojciech Sych, and the refusal to assign Justice Sych to judging panels, is "contrary to the constitutional order of the Republic of Poland." The Council further interprets this action as "effectively depriving him of the possibility to perform judicial duties."
According to Zawistowski, this interpretation of the interim measure issued by the Court of Justice of the European Union (CJEU) is "contrary to the essence of the measure." The President added that the KRS's opinion contains a "threat of responsibility towards Supreme Court judges... in the event they undertake official duties."
