Sejm to Elect New Children's Ombudsman in Two Weeks; Gawłowski Case Also on Agenda

The National Council of the Judiciary considers the order issued on November 5, 2018, by retired Supreme Court Justice Stanisław Zabłocki, regarding the "removal of cases from the court docket" assigned to Supreme Court Justice Wojciech Sych and the failure to assign Justice Wojciech Sych to judging panels, which effectively deprives him of his ability to perform his judicial duties, to be contrary to the constitutional order of the Republic of Poland – the NCS stated in its published position.

"A judge's right to adjudicate in the name of the Republic of Poland stems from the act of appointment to the office of judge issued by the President of the Republic of Poland. The Constitution of the Republic of Poland does not provide for the verification of this prerogative of the President of the Republic of Poland by any state body. Actions aimed at negating the validity of the appointment act undermine the foundations of the rule of law. In a situation where such actions are taken by an active or retired judge, they prove unworthy of the office entrusted to them by the Republic of Poland.

It is evident that the order of the Vice-President of the Court of Justice of the European Union dated October 19, 2018, under reference C-619/18, concerning interim measures, is not a law-making act and does not have a direct legal effect in the form of restoring retired judges to active service, as is clear from its content (point 1, third indent). The addressee of the order is the Republic of Poland, which has been obliged to undertake legislative actions. Until the legal status changes, the effects arising from the previously binding law remain in force. This means that retired Supreme Court Justice Stanisław Zabłocki remains in retirement and, like other Supreme Court justices who have retired, cannot undertake any administrative or adjudicative actions.

In the coming days, we will all celebrate the centenary of Poland's regaining Independence! A hundred years ago, our ancestors - through heroism, arms, and diplomatic work - fought for a free Republic for us. They gifted us a Homeland, which even today – regardless of age, place of residence, education, and profession – we all sincerely love.

In these days, we remember the fathers of our independence: Józef Piłsudski, Roman Dmowski, Ignacy Jan Paderewski, Wincenty Witos, Wojciech Korfanty, and Ignacy Daszyński. Before and after regaining independence, many issues divided them, and they often fiercely debated amongst themselves. But in those crucial days, months, and years for Poland, they had one common goal: a free, independent, sovereign Homeland.

It is thanks to the efforts of these eminent statesmen and the endeavors of the entire society that a country without its own institutions, without its own economy, without its own currency and law, became an important state on the map of Europe. It became a white and red community of the Polish Nation. The beloved Second Polish Republic.

For the past 250 years, many generations of Poles had to suffice with independence hidden in Polish hearts, minds, and hopes. For there are few countries in the world similarly tested by history. And countries that – like us – can be proud that in their difficult history, they passed the test of humanity, sacrifice, and solidarity. We passed it. But history does not end.

The anniversary of regaining independence is a date that should above all remind us of our great commitment to Poland's future. Of how our country will look in the coming years and in the next hundred years. What kind of Poland we want to leave to our children, grandchildren, our national community, in this relay of generations.

A free Poland is a commitment to set ambitious goals through which we will make Poland stronger and life in it – happier. The fundamental task of the Polish state must therefore be the consistent improvement of the quality of life for Polish families. Through pro-family policies, thanks to the entrepreneurship of Poles, by creating increasingly better quality jobs, strengthening the power of the Polish economy, we can, within a dozen or so years, achieve what has practically never happened in Poland's history: catch up with the developed countries of the West.

We must do everything to make our common home safe and prosperous for many, many years to come. This is a task for today's patriots, the government, citizens, as well as the opposition. Our common task.

Therefore, I invite all Poles, all political factions, to jointly work for our security and economic development. These can be our bipartisan commitments that we will implement beyond political divisions. There is enough room for everyone under the white and red flag! On this special Independence Day, let us joyfully celebrate our freedom. The freedom of the nation and the freedom of each of us. Let's celebrate it together, as families, with neighbors. Together with those with whom we may not fully agree on certain matters on a daily basis. But we should agree on one thing – our own, independent state is our greatest treasure, our greatest value, and our greatest chance for a good future for Poland. I wish for all of us to make the most beautiful use of this hope for a better future together. May this celebration be observed in every corner of our Homeland, but also around the world, wherever our compatriots are. May these be joint celebrations. A celebration of free and proud Poles. Poland has not yet perished as long as we live.
