"Plan B"for the KRS: Sejm Adopts Resolution

The Sejm has adopted a resolution “on restoring the constitutional standards for the election of judge members of the National Council of the Judiciary.”

In it, the Chamber declares that: “In the event of the National Council of the Judiciary being formed based on the current law [...], it will take into account in its decisions the results of elections held by Polish judges in universal and transparent elections, while considering the constitutional requirements for the Council’s composition and the limitations arising from the current law on the National Council of the Judiciary.”

Furthermore, the Sejm: “Appeals to judges to participate in the process of selecting candidates for members of the National Council of the Judiciary and to choose those who will represent all types of courts and levels of the judiciary.”

“In a situation where the effectiveness of statutory changes adopted by parliament has been halted by the President of the Republic of Poland’s refusal to sign them, special responsibility for restoring the constitutional standards of the National Council of the Judiciary’s functioning rests with the judicial community, whose activity will serve to restore the constitutional state of the National Council of the Judiciary,” it reads.

The resolution was supported by MPs from the ruling coalition (237 votes “for”), while PiS, Konfederacja, and Konfederacja Korony Polskiej voted against (a total of 199 votes).
