Żurek Recalls the Principles of the KRS Reform:
It's a distortion that judges choose themselves.
- What are the most important changes in this act? I would like to remind you once again. Something that has been postulated for many years, also when there was a different system for appointing judges, – that the appointment of judges should be done by judges, not politicians – said Waldemar Żurek at a press conference at the Ministry of Justice.
- We often have certain distortions in the public sphere, because someone says "judges choose themselves." We just forget that the National Council of the Judiciary includes six parliamentarians elected in general elections - he noted.
- There is a representative of the President, another person who has the right to vote. The President is elected in general elections. The Minister of Justice is a member of the government, and the government is formed by the majority, because they won the general elections. There are also two presidents of the supreme courts, who are also appointed by the President. So I would like us to correct these myths - he continued.
- This judicial part of the KRS, in my opinion, clearly results from the Polish constitution. […] Therefore, this new act, which is already with the President, restores compliance with the constitution, i.e., the election of the judicial part of the KRS by judges. The elections will be direct, secret, and supervised by the National Electoral Commission, which is the body that supervises all elections in Poland. Therefore, we ensure that the selection of judges is made by an independent body - he pointed out.
