President Vetoes DSA Act:

Censorship Tendencies, Orwell's Ministry of Truth

- This week, I signed another twelve acts transmitted by the Marshal of the Sejm. These are important changes to the labor code, municipal investment plans, Baltic Sea security, and an act regulating the functioning of housing cooperatives. In total, my signature has now appeared on 144 acts sent to me by the parliament - said President Karol Nawrocki in a recording published by the Chancellery of the President.

- Today, however, once again, I must say: there are limits that must not be crossed. That is why I have decided on three legislative vetos - he emphasized.

Veto on the DSA

- The act implementing the so-called DSA - Digital Services Act, which is the EU regulation on digital services - was intended to protect citizens, especially children. This is true, the virtual reality poses many threats today. This is an extremely important matter. Requiring prudent, effective, and wise regulation - he continued.

"Once again, provisions that are indefensible have been attached to good solutions"

- And that is precisely why it should not have been destroyed by bad legislative insertions. Once again, provisions that are indefensible and simply harmful have been attached to good solutions - he stated.

As he recalled: - At the end of October last year, during the legislative process, I appealed for comments on the act implementing this EU regulation. Even then, I had serious doubts about its adoption - the assumptions that transfer control over content on the internet to government officials, not independent courts.

- Unfortunately, these doubts have not been removed. Instead of real judicial review, an absurd solution has been introduced: an objection to an official's decision, which a citizen must file within 14 days - he pointed out.

"The situation resembles the structure of the "Ministry of Truth" from Orwell's book"

- I want this to resonate strongly: the situation where an official subordinate to the government decides what is permissible on the internet resembles the structure of the "Ministry of Truth" from Orwell's book "Nineteen Eighty-Four". The author wrote about a mechanism of power that first takes control of language, of information, and ultimately of citizens' thinking - he stressed.

- If the government decides what is "truth," what is "disinformation," who can speak and who cannot, freedom disappears step by step, under seemingly noble slogans of security, the common good, or the protection of the weakest - he assessed.

"I cannot sign an act that in practice means administrative censorship"

- Article 54 of the Polish Constitution states: freedom of speech is a citizen's right. The state is to guarantee freedom, not regulate it. Meanwhile, the proposed solutions create a system in which an ordinary Pole will have to fight against the bureaucratic apparatus to defend their right to express opinions. This cannot be agreed to - he stated.

- Serious constitutional doubts were also raised by authorities and institutions, including the Supreme Court. As president, I cannot sign an act that in practice means administrative censorship. All the more so, as it hides within it the possibility of financing so-called "trusted whistleblowers," who, with public funds, would point out "non-conformist" content and citizens who express such views - he continued.

"To cover up these censorship tendencies, the good of children was used"

In the president's opinion: - It is particularly outrageous that - to cover up these censorship tendencies - the good of children was used. It was to become a cynical screen behind which the real intention, namely the control of freedom of speech, would be hidden. Limiting freedom of speech is unconstitutional. Using the interests of the youngest for this purpose is immoral.

"Stop the pathology of legislative insertions"

He addressed the ruling authorities: - Therefore, I appeal once again: stop the pathology of legislative insertions. Stop the practice where bad things are smuggled into good solutions, and citizens are told: "either everything or nothing." This is a state of law, not a political bazaar.

- In this act, this pathological "insertion" maneuver was used again. Provisions that make the whole unacceptable were attached to solutions that could genuinely protect children. That is why I say: veto - he declared.
