Bodnar on Changes to the National Council of the Judiciary:
The President Should Agree to This Solution.
– It is very important to adopt a new law on the National Council of the Judiciary (KRS), so that judges have a direct influence on the election of 15 judge-members of the KRS, and to do everything possible to convince Mr. President Andrzej Duda to sign this law. Because I believe that the president should agree to a solution that, firstly, is in line with the idea and constitution and those values in terms of the separation of powers, as the election of these 15 members by the judges themselves was intended to serve this purpose. And secondly, it is a limitation of parliamentary power, so why would the president not agree to such a solution? – stated Adam Bodnar on the program “Poranek TOK FM,” when asked about the planned changes to the KRS.
– I think these are two different things, because the discussion about the future of the National Council of the Judiciary is one thing, and I think I have already expressed my view quite clearly that this legislative change would be necessary, especially since the term of office of the current body, which is currently called the National Council of the Judiciary, is ending. On the other hand, regarding disciplinary ombudsmen, let's remember that they only use the premises, meaning the National Council of the Judiciary provides administrative support for the disciplinary ombudsmen – he continued, when asked about reports from “Republika” about a forceful entry into the KRS headquarters.
– However, it is worth emphasizing that these ombudsmen were dismissed a long time ago, perhaps not very recently, but several good months ago, and new disciplinary ombudsmen were appointed. Moreover, all those cases that were sensitive in terms of ideology, politics, and the approach to the rule of law, conducted by ombudsmen Schab or Radzik, have long been taken over by ad hoc disciplinary ombudsmen, who have largely removed the burden of trauma that hung over judges acting in favor of respecting the rule of law – the former minister noted.
