The adjudicating panel included 'dubler judge' Mariusz Muszyński and two 'successors to dublers,' namely Justyn Piskorski (who also served as the rapporteur in the case) and Jarosław Wyrembak, individuals who were elected and appointed to previously occupied positions. These are unauthorized individuals who are not judges of the Constitutional Tribunal. Additionally, the adjudicating panel was presided over by Judge Julia Przyłębska – elected as the President of the Constitutional Tribunal in a manner inconsistent with procedures. Finally, the proceedings were marred by procedural errors. The Sejm's stance, presented at the Constitutional Tribunal by PiS MP Barbara Bartuś, was not previously adopted by the Legislative Committee.
