Tuesday's Political Agenda: Macron's Second Day in Poland, Senate Committees on KRS Bill, Government on F-35s

Tuesday marks the second day of Emmanuel Macron's visit to Poland. At 12:00 PM, the President of France will deliver a lecture for students at the Jagiellonian University.

Also today, the President of North Macedonia, Stevo Pendarovski, and his spouse will be visiting Poland. An official welcoming ceremony is scheduled for 11:15 AM, followed by presidential couple talks at 11:30 AM, and one-on-one talks between the presidents at 11:40 AM.

At 12:00 PM, plenary delegation talks led by the presidents will take place, followed by media statements at 12:45 PM, and a breakfast hosted in honor of the President of North Macedonia at 1:15 PM. Further agenda items include meetings with the Marshal of the Sejm, Elżbieta Witek, at 3:20 PM, and with the Marshal of the Senate, Tomasz Grodzki, at 4:05 PM.

A government session will be held at 10:00 AM. The agenda includes, among other items, information from the Minister of National Defence related to the acquisition of 5th-generation multirole F-35A aircraft for the Polish Armed Forces from the United States government.

At 5:00 PM, during a session of two Senate committees, the first reading of the draft amendment to the Act on the National Council of the Judiciary will take place – this is the so-called Senate bill on the KRS, presented by the opposition in January. The committees are also to consider adopting a resolution on conducting a public hearing. The Senate's proposal envisages replacing the current model of electing judges to the KRS by the Sejm with a model based on the principle of direct and universal elections among judges.

Mitera on support lists for the National Council of the Judiciary: I met the legal requirement

- The people who signed [the support lists for the KRS] guaranteed it to me, in my opinion. My acquaintances, people I had… However, the requirement was 25 people, prosaically speaking, whether more or less, I met the legal requirement. I always act in trust of the state, and if a certain body was appointed to check formally, then I trust that was the case - stated Maciej Mitera in an interview with Konrad Piasecki on TVN24's "Rozmowa Piaseckiego".

08:00

Müller:

There is no question of any civil partnership bill. Such a bill will not be adopted by the government.
I can imagine having a friend, a female friend, a family member, whom I want to authorize in some way to have easier access to my tax and health data, and such regulations already exist. Perhaps some can be accelerated, but there is no question, and I want to emphasize this clearly, of any civil partnership bill. Such a bill will not be adopted by the government, nor by the parliamentary majority – said Piotr Müller in an interview with Piotr Witwicki on Polsat News's "Graffiti".

08:02

Mitera:

It's the Head of State's prerogative, and if the Head of State has deemed everything correct, in my assessment, that settles the matter.
Full agreement. Please note, it's as if, I beg this not to be misinterpreted in any way, it's like the king of old, now the president shares this state power empire with the person to whom they are transferring judicial power. Yes, it is the prerogative of the head of state, and if the head of state has deemed everything correct, in my assessment, that settles the matter - stated Maciej Mitera in a conversation with Konrad Piasecki on TVN24's "Rozmowa Piaseckiego".

08:08

Mitera:

As a Judge, I Say: This is a Resolution of the United Chambers of the Supreme Court

- A politician can say various things. As a judge, I am telling you and the viewers: this is a resolution of the United Chambers [of the Supreme Court]. It has the force of a legal principle. You cannot move on as if nothing happened: you cannot. The judges issued it, yes - stated Maciej Mitera in a conversation with Konrad Piasecki on TVN24's "Rozmowa Piaseckiego" program.

08:16

Mitera on Supreme Court Resolution: In My Opinion, Ordinary Court Judges Should Decide Conscientiously: I Have This Impartiality Within Me, This Independence
In my opinion, [ordinary court judges, after the Supreme Court resolution has been issued] should decide conscientiously: I have this impartiality within me, this independence. I will cap this off by saying: we, as judges, have very significant rights, we have duties. These rights should be defended, and these duties should be performed - stated Maciej Mitera in an interview with Konrad Piasecki on TVN24's "Piasecki's Conversation".

08:16

Müller:

France and Poland Share Common Interests, Including Nuclear Power and Rail Infrastructure for CPK

- France and Poland have several shared interests. One of them is the issue of nuclear power plant construction. France is a very significant player in this field, accounting for over 70% of their energy. Negotiations are ongoing with the Americans, and recently, the Prime Minister and I visited Japan, where new technologies for small modular nuclear reactors are being developed, and the French are also involved. Therefore, it is worthwhile to discuss this in such a forum to negotiate the price, but also to scrutinize the technology, as it is, of course, of paramount importance. The second area in the context of CPK construction pertains to railways – said Piotr Müller in an interview with Piotr Witwicki on Polsat News's "Graffiti" program.

08:20

Müller:

The Justice System Falls Under National Regulations; the European Union Lacks Competence in This Area
There are areas that fall under EU regulations and there are areas that are covered by national regulations. The justice system is an area covered by national regulations, and the European Union does not have competence in this matter. Of course, we can talk, exchange best practices, but we are demonstrating that we adopt many of these best practices from countries such as Germany or France – said Piotr Müller in an interview with Piotr Witwicki on Polsat News's "Graffiti" program.

08:25

Sasin on Macron's Statement Regarding Judicial Reform During Conference with the President of Poland: "Ritual Chants"

- I understand that President Macron felt obliged to utter these ritual chants. He uttered them, and we are past that - said Jacek Sasin in a conversation with Robert Mazurek on RMF FM's "Morning Interview".

- I think the opposition is disappointed with the tone of Macron's statement. We are not disappointed - Sasin added.

08:29

Sasin:

If we're discussing whether there should be 10 fewer or 10 more deputy ministers for a country like Poland, we're truly talking about a superficial problem

- If we are discussing whether there should be 10 fewer or 10 more ministers, deputy ministers, for a country like Poland, then we are truly discussing a problem that is a superficial problem - said Jacek Sasin in an interview with Robert Mazurek on RMF FM's "Morning Interview".

09:22

Czarzasty:

I Rate Macron's Visit Positively. Poland Automatically Rose After Brexit

"Regarding Mr. Macron's visit to Poland, I rate it positively. As one of the opposition leaders, I believe that at this moment, after Brexit, Poland automatically rose. I think everyone needs Poland because it's a large nation, strategically located, and this is, in a way, normal. However, please remember that recently, perhaps a week ago, Macron in Israel supported the idea of convening – this passed rather quietly in Poland – of convening the permanent members of the UN" – said the Deputy Marshal of the Sejm from the Left, Włodzimierz Czarzasty, in an interview with Beata Lubecka on Radio Zet.

09:29

Spychalski:

If Brudziński were to lead the campaign headquarters, cooperating with him would be a great honor for me

Joachim Brudziński is a very good politician, a tested, experienced, and highly competent person. I have cooperated with Joachim Brudziński for many years. It was a fantastic period of my collaboration. He is an exceptionally competent individual. If Joachim Brudziński were to lead the campaign headquarters, and I were to cooperate with Joachim Brudziński, it would be a great honor for me” – said Minister and President's Spokesperson Błażej Spychalski in an interview with Beata Michniewicz on Radio Trójka.

09:29

Kempa:

Macron's Visit Marks a Breakthrough in Polish-French Relations
I believe that the French President's visit holds enormous significance for us, for Europe. It certainly marks a breakthrough in Polish-French relations, and that's true after many years. It's also a huge success for President Duda, but we also know that we are in such a situation, at such a political moment, when Brexit has become a fact. At this moment, the scene, including the scene of mutual relations, which can naturally result in cooperation in various fields, will also be the case, I have great hope, in Polish-French relations in political areas, economic ones, and of course military ones, which has already been highlighted during this visit – stated Beata Kempa in an interview with Piotr Gociek on PR1's "Sygnały dnia". This is another example that our president is taking excellent care of our affairs, now talking with a president playing a key role in the EU, a country that plays a key role in the union – the United Right MEP continued.

09:29

Spychalski on Macron's Visit: It Was a Very Good Visit. Very Good, Extended Talks with President Duda

"It was a very good visit. Very good, extended talks with President Duda, which also indicates that these conversations took place in a very good atmosphere. Many issues were raised, important issues for Poland, France, our bilateral matters, but also international issues related to security," said Minister and Presidential Spokesperson Błażej Spychalski in an interview with Beata Michniewicz on Radio Trójka.

09:46

Kempa:

Judicial Reforms Are Exclusively the Domain of Member States, Thus Exclusively Poland's Domain in This Case. They Are Constitutional.

- Yes, Vera Jourová is known for not being fond of Poland. We used to wonder here [in Brussels] in a casual conversation whether it was more or less than Frans Timmermans, but the matter is serious. Specifically, we also proposed a debate in the EP, during the last session in Strasbourg, on the rule of law in France, concerning those images that went around the world. Perhaps I could comment on this by saying: we have a guest in our country, so we would like, in our Polish hospitality, to receive them as best as we can, but still draw attention to the fact that matters of the rule of law and judicial reforms are exclusively the domain of member states, and therefore, in this case, exclusively Poland's domain. They are constitutional, and I believe that interfering in such matters is inappropriate, especially if things are not going well in the country from which one comes. The images showing how lawyers were treated in the Supreme Court in Paris speak for themselves – stated Beata Kempa in an interview with Piotr Goćek on PR1's "Sygnały dnia".

Judge Juszczyszyn Suspended and Salary Reduced by 40%

11:13

Kozielewicz:

A Nearly 29-Year Era in Poland, Where the Electoral Commission Was Composed Solely of Judges, Ends Next Week

The chairman will be chosen from among two judges. One is designated by the President of the Constitutional Tribunal. The second judge is designated by the President of the Supreme Administrative Court. From these two, the National Electoral Commission (PKW) in its new formula will elect the chairman. This is already defined by law. Next week, a nearly 29-year period in Poland will end; we were an anomaly regarding the system of the PKW, where the Electoral Commission was composed solely of judges” – stated the outgoing chairman of the National Electoral Commission, Judge Wiesław Kozielewicz, in an interview with Jacek Prusinowski on Radio Plus.

11:14

Kozielewicz on PKW Changes: There is a Certain Danger, as the Polish Commission, Unlike Many European Commissions, Also Deals with the Control of Political Parties' Finances

"There is a certain danger, because the Polish National Electoral Commission, unlike many European commissions, also deals with the control of political parties' finances. A certain conflict of interest may arise. A person who is nominated by a specific political party, according to the law, if the financial report of one of the parties that nominated a candidate is to be examined, a certain conflict may arise" - said the outgoing chairman of the National Electoral Commission, Judge Wiesław Kozielewicz, in a conversation with Jacek Prusinowski on Radio Plus.

11:35

Nawacki on Juszczyszyn: I Will Fully Comply with the Disciplinary Chamber of the Supreme Court's Ruling. Judge Juszczyszyn No Longer Presides, His Cases Will Be Redrawn.

12:12

Gasiuk-Pihowicz on Sejm Chancellery's statements regarding support lists for KRS candidates: A handful of dry statistics. It in no way fulfills the NSA's ruling.

The Sejm Chancellery is obliged to disclose the full lists of support for members of the National Council of the Judiciary, including the names and surnames of those who signed. What has been published by the Sejm Chancellery is merely a handful of dry statistics and in no way fulfills the NSA's ruling. What is so contained within these lists that PiS is so frantically afraid of them being made public? After the NSA's ruling, everything is clear and transparent. The public has the right to know who signed these lists” - stated Kamila Gasiuk-Pihowicz from Civic Coalition at a press conference in the Sejm.

12:19

Gasiuk-Pihowicz on the Supreme Court Disciplinary Chamber's Decision on Juszczyszyn: Political Persecution of a Judge and Proof of the Chamber's Politicization

The Disciplinary Chamber, in light of the rulings of the Supreme Court and the EU Court, is not a court. The judges who adjudicate there were appointed by the National Judicial Council and, quite simply, have no right to adjudicate. The actions concerning Judge Juszczyszyn are nothing more than the political persecution of a judge who firmly stands on the ground of the law, and this is proof of the politicization of the Disciplinary Chamber” - stated Kamila Gasiuk-Pihowicz of Civic Coalition at a press conference in the Sejm.

13:38

Buda on Juszczyszyn: He Wants to Present Himself as a Victim of Certain Changes, When in Reality He Should Comply and Be Part of Those Changes
'This matter shows in a nutshell what this entire dispute is about. It's about whether to draw consequences for behavior that is contrary to the law or the ethical principles of judges, or not. It shows whether a judge should bear responsibility for their actions or not. I am convinced that the [Disciplinary Chamber] court is functioning and I absolutely disagree with the Supreme Court's resolution, especially since the Constitutional Tribunal has suspended its validity' – said Deputy Minister Waldemar Buda in an interview with journalists in the Sejm.

When asked if he would call Judge Juszczyszyn a 'celebrity' like Judge Radzik, he replied: 'This is an extra-legal assessment, but if I have to comment as a politician, that's how I assess it, exactly how I assess it. He wants to present himself as a victim of certain changes, when in reality he should comply and be part of those changes. That's how he should be assessed. His media appearances, his involvement. I have seen a lot of articles and interviews with him. I have seen protests, marches, but also his actions show that he wants to get involved in this dispute by coming to the Sejm'.

14:36

Macron:

I see such temptations in Poland to erase the date of 1989

We will not build Europe by forgetting Europe. We will build Europe by knowing its history and defending it against all attempts to falsify or rewrite this history. Regardless of which country or which party is the author of such falsification. We cannot erase anything at this moment. We must look soberly. We cannot erase traces. We must also allow a conflict or dispute to emerge between scientists and historiographers. In this way, the true history of our nations will see the light of day. We must build a common European memory” - said the President of France, Emmanuel Macron, during a lecture at Jagiellonian University.

I see such temptations in Poland to erase the date of 1989, and in Hungary there is also such an approach to rewriting the history of the 20th century. Russia would like to reinterpret World War II and lay the blame on the Polish nation. I see here the risk of diluting our histories through historical revisionism” - he added.

14:49

Duda:

President Macron invited to Weimar Triangle meeting on July 14th
“President Macron, I won’t hide it, although it’s still unofficial, he invited me yesterday to participate in this [Weimar Triangle] meeting, which he told me he wants to organize on July 14th. This is a very important signal, because I don’t think any of you have any doubts that if this format convenes at a time of such significant changes in the EU and the shifts resulting from Brexit, it is a politically very significant moment for us. Of course, I am pleased that this meeting will take place. Secondly, it is always worthwhile to talk with the highest representatives of the authorities of France and Germany about the future of Europe and the EU. These are currently the most powerful states in Europe,” said President Andrzej Duda at a press conference following his meeting with the President of North Macedonia.

15:26

Nawacki on Juszczyszyn: I am obliged to issue an order suspending him from all duties at the court

- I have received the following information: that Judge [Paweł Juszczyszyn], who is a judge at my court, has been suspended from his official duties. This is a ruling from the Disciplinary Chamber of the Supreme Court in the second instance, as the initial decision was made on December 23, 2019. I know he has been suspended from his duties, and this is linked to a 40% reduction in his salary. For now, I am awaiting official confirmation of this fact by receiving the content of the ruling. As soon as this ruling is delivered, my order will come into effect, which is of an exclusively technical nature and essentially organizes the matters concerning the judge's adjudication at the court. Given that the judge has been suspended from his duties by the court, I am obliged to issue an order suspending him from performing all duties at the court, meaning all his cases will be taken away from him at that moment and then distributed among the remaining judges - stated Judge Maciej Nawacki at a press briefing.

- The second action is related to technical matters of access to the IT system, to the court's restricted areas, meaning all electronic access is also suspended at this moment, as well as access to the premises - he continued.

President Signs Law to Discipline Judges

The President of the Republic, Andrzej Duda, has signed the so-called "lex తెలంగాణ" (lex Tusk) bill, which introduces disciplinary responsibility for judges. The bill was passed by the Sejm (lower house of parliament) on January 10th and by the Senate on January 23rd. The new law aims to discipline judges, particularly those who are perceived as acting politically and undermining the judiciary. Critics, however, argue that the law is an attempt to exert political control over the courts and limit judicial independence.

18:41

Kidawa-Błońska:

Duda's Signature Seals Assault on Rule of Law; He Abdicated by Causing Destruction in Poland's Legal System

"Today is a truly very sad day in Poland for all of us Poles, because today President Duda, with his signature, has sealed the assault on our rule of law. He did not heed the opinions of experts, nor the opinions of the opposition. He also did not listen to European politicians supporting us. He did this because he is a president who does not make decisions independently. Today we saw a frightened, inert president, who signs every document he receives from his party leader. Today, by causing this destruction in the Polish legal system, the president has abdicated. We do not have a president for all Poles. We have a president who only signs laws indicated by the party chairman. This is truly a very sad day," said Małgorzata Kidawa-Błońska, Deputy Marshal of the Sejm and Civic Coalition's presidential candidate, in a conversation with TVN24 and RMF FM journalists.

18:42

Kidawa-Błońska on PAD signing disciplinary law: This is the beginning of Polexit. We are stepping outside the European legal system

The signing of this law is the beginning, the start of this [Polexit]. We are stepping outside the European legal system. The values that are important in the Union will no longer apply to us. Values do not matter to PiS” - said the Deputy Marshal of the Sejm and Civic Coalition presidential candidate Małgorzata Kidawa-Błońska in an interview with TVN24 and RMF FM journalists.

19:36

Budka on Signing the Judges Disciplinary Bill: The President Pays Fealty to Zbigniew Ziobro

- I am disappointed because this was a test for the head of state: whether he would align himself with this harmful policy that infringes upon fundamental civil rights, or if he would demonstrate that he is the head of state and capable of acting independently for the good of Poland. I lament this. The President's decision is a pity, I am surprised by it, and I absolutely disagree with it - said Borys Budka in an interview with Dorota Gawryluk on the program "Gość Wydarzeń" on Polsat News.

- The President is absolutely behaving as if he were a spokesman for the Minister of Justice, whom he only recently warned against. I will remind you that he vetoed the act on the Supreme Court and the National Council of the Judiciary; at that time, he cited as his motivation that he would not hand over the judiciary to Zbigniew Ziobro. Unfortunately, here he is practically paying fealty to Zbigniew Ziobro - added the Civic Platform leader.

19:41

Budka:

Court proceedings are getting longer. This government has increased fees and access to justice. The prosecution has been politicized. There is no reform here.

- Today, the problem isn't that someone wasn't punished out of 12,000 people, because these are cases from the past, from five or seven years ago, as the disciplinary system is now working. What is the problem today? That court proceedings are getting longer. That this government has increased fees and access to justice. That the prosecution has been politicized. There is no reform here - said Borys Budka in an interview with Dorota Gawryluk on the program "Gość Wydarzeń" on Polsat News.

19:49

Budka on Macron's Lecture: I Regret That Jagiellonian University Graduate Andrzej Duda Didn't Listen to These Words. He'd Be Red if He Heard the French President Championing Values That Today's President Trampled with His Signature

- I expected these declarations about values from President Macron. I don't know if one can strongly state things about values, for example, regarding the sphere of the rule of law. President Macron, in his lecture for students today, clearly stated that certain lines will not be crossed. I regret that a graduate of the Jagiellonian University, meaning President Andrzej Duda, did not listen to these words, because I think he would be very red today if he heard the President of France championing these values, which the current President has simply trampled with his signature - said Borys Budka in an interview with Dorota Gawryluk on the program "Gość Wydarzeń" on Polsat News.

20:10

Kidawa-Błońska:

President Duda Approves Coup Against Polish Rule of Law. It's a Day of Shame. The President is Unworthy of Being Treated as Our Country's President, as He Has Simply Betrayed Us

On this painful and difficult day for us, we must be at the Presidential Palace because the truth must be told. President Duda has abdicated. He does not listen to citizens. He does not listen to the fact that the Union is of great importance to Poles, their security, and their freedom; he has merely signed a bill pushed by Chairman Kaczyński. The President is a lawyer, and a lawyer knows what is in this bill. The President has shown that Poles do not interest him at all. He has, in fact, simply betrayed us. He betrayed us, setting Poland on a direct course to be taken out of the European Union. The President has not kept his oath, as he neither guards the constitution, nor guards the security of Poles, nor our freedom. It was only out of fear of the Chairman that he signed such a dramatic bill. He has destroyed, dismantled to the very end, the system of separation of powers in Poland. In truth, with his signature, he has approved a coup against Polish rule of law. It's a day of shame. The President is unworthy of being treated as our country's president, as he has simply betrayed us” - said Małgorzata Kidawa-Błońska, Deputy Marshal of the Sejm and Civic Coalition's presidential candidate, at a press conference in front of the Presidential Palace.

20:12

Zandberg on the Judges' Disciplinary Law: The Law Will Simply Have to Be Undone

- This is not a surprise, but it was a bad thing, of course, and this law will simply have to be undone. Besides, at the moment we are talking, Robert Biedroń is standing by the President's seat, announcing at his press conference one of his future presidential initiatives, which is the adoption of a law that effectively repeals the adoption of this law - said Adrian Zandberg in an interview with Grzegorz Kajdanowicz on TVN24's "Fakty po faktach".

20:18

Zandberg to Fogiel: I Want Judicial Reform. The Problem with Your Proposed Changes is That They Are Stupid and Harmful

- Mr. Deputy, I want changes in the judiciary. The problem with the changes you are proposing is that they are stupid changes and harmful changes, because they do not shorten the queues. The queues have lengthened under PiS rule. They do not improve the situation of the less affluent in the courts. Legal aid still does not work well. We continue to have a nonsensical situation where a significant portion of cases that could be handled by institutions other than courts, such as the notary's office, unnecessarily burden the courts and lengthen the queues - said Adrian Zandberg in an interview with Grzegorz Kajdanowicz on TVN24's "Fakty po faktach".

20:22

Zandberg to Fogiel: This Law is Actually a Continuation of Your Very Dangerous Game of Top-Down Takeovers, Not Bottom-Up Reforms
In my opinion, it is very unfair when you speak about people expecting changes in the courts, and at the same time, you mention this [disciplinary] law, because from the perspective of ordinary people, this law changes nothing. This law is actually a continuation of your very dangerous game of top-down takeovers of institutions, rather than fixing them from the bottom up – said Adrian Zandberg in an interview with Grzegorz Kajdanowicz on TVN24's "Fakty po faktach".

20:28

Fogiel:

In a Few Months, Poles Will Be Able to Say Whether They Want Things to Stay as They Were, or if They Want an Efficient Judiciary

There is a huge expectation from citizens to carry out judicial reform. This act, among other things, stabilizes the justice system, which was threatened by the actions of judges who decided to usurp the right to decide who is a judge and whose rulings are binding. This is an act that ensures legal security for Poles – said Radosław Fogiel in an interview with Grzegorz Kajdanowicz on TVN24's “Fakty po faktach”.

In a few months, Poles will be able to say whether they want things to stay as they were, or if they want an efficient judiciary – Fogiel added.

20:32

Budka:

Instead of a Head of State, We Have a Weak Politician Acting as a Transmission Belt from Nowogrodzka Street

“Today, when it comes to the safety of Poles, we need a president who understands that turning away from European communities, from the European Union, is contrary to Poland’s national interest. Today, the Palace needs a true master of the house, someone who is not afraid to make independent decisions. Today, instead of a person who should be the head of state, we are dealing with a weak politician who has become a transmission belt from Nowogrodzka Street. Signing this law is a feudal tribute to Zbigniew Ziobro and President Kaczyński” - stated PO Chairman Borys Budka at a press conference in front of the Presidential Palace.

20:33

Fogiel on Lengthening Court Queues: 'If a Large Part of the Judiciary is de Facto in a Political War with the Government, I Can Assume Some Judges May Want to Conduct a Go-Slow Strike'

- We, as the ruling party and any ruling political force, can provide opportunities and create conditions for proceedings. If a large part of the judiciary is de facto in a political war with the government, then I am very sorry, but I can assume that some judges may also want to conduct a kind of go-slow strike - said Radosław Fogiel in an interview with Grzegorz Kajdanowicz on TVN24's 'Fakty po faktach'.

21:01

Juszczyszyn:

Tomorrow I intend to proceed with hearing an appeal case assigned to my docket, with a panel of three judges.

- Therefore, tomorrow - February 5, 2020, at 11:45 AM at the District Court in Olsztyn, I intend to proceed with hearing an appeal case assigned to my docket, with a panel of three judges. I wish everyone, and especially judges in the current situation, courage and perseverance! Stay strong! - wrote Paweł Juszczyszyn on Facebook.
