Monday's Political Agenda: Commemorating the 75th Anniversary of the Liberation of Auschwitz

Today, official commemorations will take place marking the 75th anniversary of the liberation of the German Nazi concentration and extermination camp Auschwitz. The Polish President will meet, among others, with the Presidents of Israel and Ukraine. The main ceremonies are scheduled for 3:30 PM, at which time the head of state will deliver a speech.

In the morning, at 8:30 AM, the President of the Republic of Poland (PAD) will lay a wreath before the Wall of Death. At 10:05 AM, plenary talks will be held between delegations led by the President of the Republic of Poland and UNESCO Director-General Audrey Azoulay. At 11:00 AM, the Presidents of Poland and Israel will lay flowers before the monument to Rotmistrz (Captain) Witold Pilecki, and at 11:05 AM, a meeting of the presidents will take place.

At 11:20 AM, plenary talks between the Polish and Israeli delegations will commence. At 12:10 PM, statements to the media by the Presidents of Poland and Israel, Reuven Rivlin, are scheduled. At 12:40 PM, plenary talks will begin between delegations led by the Presidents of Poland and Ukraine, Volodymyr Zelensky. Statements by the presidents to the media are scheduled for 1:05 PM.

- The Supreme Court stated this in a very cautious, balanced, and straightforward manner. There are two situations here. One situation concerns cases where rulings have already been issued before January 23rd, or where proceedings are still ongoing but commenced before January 23rd. In these instances, there are no grounds to question these rulings due to the court being improperly constituted. The second issue pertains to rulings and proceedings that began after January 23rd with the participation of judges whose appointment is flawed. And here, there is no rule, no compulsion, no predetermined outcome that rulings eventually issued by these judges will be flawed - stated Wojciech Hermeliński in an interview with Konrad Piasecki on TVN24's "Piasecki's Interview."

- The Supreme Court said it depends on the circumstances, on the procedure for appointing that judge. I see it this way: one must trace the entire path of this judge's appointment. Because if it turns out that this entire procedure starts with the court, with the general assembly of judges, then the judicial college, then the case goes to the National Council of the Judiciary (KRS). If it turns out that the general assembly and the college provided a positive opinion, and the KRS also agreed with these conclusions and presented the candidate to the president, and the president appointed them, then there are no reasons to question that person - he continued.

Pain can cause change, pain causes suffering, but pain cannot cause us to alter our understanding of facts. Today, I pay tribute to all the victims of this greatest crime in human history. For us Poles, the memory of this crime has exceptional significance. The Holocaust destroyed the entire Jewish world that was formed and developed in our country. The remnants of this world are remembered and commemorated by the POLIN Museum – stated Małgorzata Kidawa-Błońska during the observance of the International Day of Remembrance of the Holocaust. We, Poles, have a special duty to remember our Jewish neighbors, acquaintances, friends, to remember their culture. But it is especially important that we remember this unimaginable crime, as a result of which they were exterminated. And we are all aware that in the discussion about the Holocaust, the voice from Poland cannot be absent. It is our duty to remind everyone of what a human being is capable of when driven by hatred towards another person. Totalitarian terror did not arise in an instant; racism and anti-Semitism had been poisoning human minds for a long time. Today, we know well that not reacting to evil causes it to spread with great force. It is also our duty to remind of the truth, the truth. The truth about why World War II broke out, what its consequences were, and who bore the greatest victims in this war. We must remember that its consequence was the Holocaust, but also the extermination of Poles, Roma, and many other nationalities. Falsifying the history of World War II is an insult to the dignity of those who died in it, who gave their lives. It also prevents us from drawing lessons from the past, so as not to commit further crimes and mistakes. For me, as a Warsaw resident, these ceremonies in this place have exceptional significance. Because after all, the Warsaw Ghetto Uprising did not arise for unitary reasons; it erupted in order to defend human dignity, the human being – continued the Deputy Marshal of the Sejm. Let's fight hatred, let's not be indifferent to evil, let's respect and love people. And let's remember what a human being can do to another human being. This memory should be very, very important to us – she emphasized.

President Andrzej Duda has submitted a request to the Constitutional Tribunal, under ex-post review, to examine the compliance of the following provisions with the Constitution: the Code of Civil Procedure, the Code of Criminal Procedure, and the Act on the Supreme Court – the Chancellery of the President announced.

Article 379 point 4 of the Act of November 17, 1964 – Code of Civil Procedure (Journal of Laws of 2019, item 1460, as amended) in the scope concerning the inclusion as a ground for the invalidity of proceedings, the assessment of the independence of the National Judicial Council and the correctness of the procedure preceding the appointment by the President of the Republic, upon the motion of the National Judicial Council, to hold office as a judge of a common court, a judge of a military court, and a judge of the Supreme Court, from Article 179 in conjunction with Article 144 paragraph 3 point 17 and Article 126 paragraph 1 and 2, Article 10, Article 176 paragraph 2, Article 180 paragraph 1, and Article 183 paragraph 1 and 2 of the Constitution,

II. Article 439 § 1 point 2 of the Act of June 6, 1997 – Code of Criminal Procedure (Journal of Laws of 2020, item 30) in the scope concerning the inclusion as grounds for the annulment of the appealed judgment, the assessment of the independence of the National Judicial Council and the correctness of the procedure preceding the appointment by the President of the Republic of Poland, upon the motion of the National Judicial Council, to hold office as a judge of a common court, a judge of a military court, and a judge of the Supreme Court, from Article 179 in conjunction with Article 144 paragraph 3 point 17 and Article 126 paragraph 1 and 2, Article 10, Article 176 paragraph 2, Article 180 paragraph 1, and Article 183 paragraph 1 and 2 of the Constitution,

III. Article 83 § 1 of the Act of December 8, 2017 on the Supreme Court (Journal of Laws of 2019, item 825) in the scope where:
– the subject of the resolution of a legal issue by the Supreme Court is the determination of the ground for establishing the improper composition of the court within the meaning of the provisions of the Act of November 17, 1964 – Code of Civil Procedure and the Act of June 6, 1997 – Code of Criminal Procedure, due to the participation in the court's composition of a person appointed by the President of the Republic of Poland to hold office as a judge of a common court, a judge of a military court, and a judge of the Supreme Court, under the procedure indicated in the resolution of the Supreme Court from Article 179 in conjunction with Article 144 paragraph 3 point 17, Article 10, Article 176 paragraph 2, and Article 180 paragraph 1 and Article 183 paragraph 1 and 2,
– the subject of the resolution of a legal issue by the Supreme Court is the determination of the legal consequences, in relation to judgments issued by the Supreme Court, common courts, and military courts, in the event that a person appointed by the President of the Republic of Poland to hold office as a judge of a common court, a judge of a military court, and a judge of the Supreme Court, under the procedure indicated in the resolution of the Supreme Court from Article 179 in conjunction with Article 144 paragraph 3 point 17, Article 10, Article 176 paragraph 2, Article 180 paragraph 1, and Article 183 paragraph 1 and 2, participates in the court's composition.

The Prime Minister of Poland (PMM) in Berlin, at a concert celebrating the 75th anniversary of the liberation of the German Nazi concentration camp Auschwitz-Birkenau, delivered a speech following Chancellor Angela Merkel. The German Chancellor unequivocally emphasized the responsibility of Germans for the crimes of World War II.

- We oppose the denial and distortion of the history of the Holocaust. We are determined to respond decisively to attempts to exploit the 75th anniversary of the liberation of Auschwitz-Birkenau and the memory of the camp's victims for current political purposes. KL Auschwitz-Birkenau was not the only hell on earth. The second hell was named the Gulag. Both these places deserve special care so that the past serves as a lesson for future generations. As descendants of our grandmothers and grandfathers who perished in Auschwitz and amidst the snows of Kolyma, we have a moral obligation to tell this story to the world. May no one ever have to experience it again. The memory of the victims is an important part of our identity. The Prime Ministers of Germany and Poland stand together in this appeal – united by the conviction of the need to preserve the memory of the difficult chapters of our shared history - stated Morawiecki.
