Fogiel on Constitutional Tribunal Judges' Swearing-In: 'Everyone's Been Talking About It Since Yesterday, So I Wouldn't Overdo the Mystery. Secrecy is More Like Meeting at a Gas Station, Under a Dumpster, or in a Cemetery to Arrange Something.'

- I wouldn't say [the atmosphere at the swearing-in of newly elected Constitutional Tribunal judges] was mysterious. Secrecy is more like if someone were meeting someone, for example, at a gas station, or under a dumpster, or in a cemetery, and arranging something there. That, I would call secrecy. The Belvedere, the President's residence, it's hard to say it's shrouded in a veil of mystery. Besides, everyone's been talking about it since yesterday, so I wouldn't overdo the mystery - stated Radosław Fogiel in an interview with Wojciech Dąbrowski on Polsat News's "Graffiti".

08:12

Fogiel:

Rzepliński Has Now Completely Dropped His Mask of Non-Partisanship. He Can Visit Civic Platform's Headquarters on Wiejska Street as Often as He Likes

- Professor Rzepliński is showing that he has now completely dropped his mask of non-partisanship, which he has every right to do. He has every right to do so, no longer being the President of the Constitutional Tribunal. He can now visit the Civic Platform's headquarters on Wiejska Street as often as he likes, because we remember that he used to do it somewhat secretly before, but he now exclusively positions himself as a politician - stated Radosław Fogiel in an interview with Wojciech Dąbrowski on Polsat News's "Graffiti," commenting on Andrzej Rzepliński's interview with "Rzeczpospolita".

- Comparing democratically elected state authorities, the government formed by PiS, with the times of General Jaruzelski is a mockery of the victims of martial law, a mockery of all those who remember the Polish People's Republic, and if these are not symptoms of some temporary mental eclipse, then it is scandalous - added the PiS deputy spokesperson.

Gersdorf on the Disciplinary Chamber of the Supreme Court: I Will Not Change the Law or Dismiss Judges Based on a Single Ruling. I Lack the Powers of the Legislator. I Appeal for the Legislator to Seriously Address the Matter.
“We must consider how we will interpret this ruling [of the Chamber of Labour of the Supreme Court] and how I will interpret this ruling for myself, what I will do in this regard. The ruling is unambiguous and carries significant weight for all courts, as it concerns the execution of a ruling by the ECJ. It holds almost the same value as a ruling from Luxembourg,” stated First President of the Supreme Court, Małgorzata Gersdorf, in an interview with Jacek Żakowski on Poranek Radia TOK FM.

“I will not change the law or dismiss these judges after a single ruling. I do not have the powers of the legislator. I can appeal, and I have been doing so from the beginning, to the legislator to seriously address this matter, because the Supreme Court and other legal bodies have long contested the Act on the Supreme Court, particularly concerning the composition of the Disciplinary Chamber and the National Council of the Judiciary (KRS),” she added.

08:21

Fogiel:

We are all disappointed that Banaś decided to make such a decision

- We are all, not just PiS leaders, but we are all disappointed that President Banaś decided to make such a decision. This appeal to him to resign was an expression, let's say, of the political will of the environment that proposed him for this position - stated Radosław Fogiel in an interview with Wojciech Dąbrowski on Polsat News' "Graffiti".

- I think that in politics, especially when we talk about important matters, because of course sometimes part of politics are meaningless squabbles or verbal games. But when we talk about truly important matters, affecting the state, its functioning, there is no point in talking about insults or courtesies. Here, tough decisions are simply needed - the PiS deputy spokesperson continued.

08:22

Gersdorf on Judges of the Disciplinary Chamber of the Supreme Court: They Should Refrain from Judicial Activity. I Will Definitely Appeal to Them.

“I don't have the authority over them [judges of the Disciplinary Chamber of the Supreme Court] to take away their robes, their money. They have their own money. They are a court within a court. They should refrain from judicial activity. I will definitely appeal to them about this. What happens next depends on the legislator, how they regulate it,” said the First President of the Supreme Court, Małgorzata Gersdorf, in an interview with Jacek Żakowski on Radio TOK FM's "Poranek" program.

08:47

Gersdorf:

I Did Not Consider It Appropriate to Go to the Presidential Palace, as They Were Not Suitable Candidates for the Constitutional Tribunal, for Individuals Who Significantly Violated the Constitution to Hold Office. I Do Not Approve of Such Actions
"I did not go [to the swearing-in of the new Constitutional Tribunal judges] because I did not consider it appropriate to go to the Presidential Palace. There are three candidates for the Constitutional Tribunal judges who have been waiting to assume these positions for years. The President does not swear them in, but instead swears in new ones, claiming he cannot avoid swearing them in. That's how the Presidential Chancellery is playing it a bit. This is the fundamental reason why I did not go. I do not believe, but my assessment is irrelevant, that individuals who have significantly violated the constitution are suitable candidates to hold the positions of Constitutional Tribunal judges. I do not approve of such actions." - said the First President of the Supreme Court, Małgorzata Gersdorf, in an interview with Jacek Żakowski on TOK FM Radio's Poranek program.

09:53

Woś:

The Supreme Court Acted Against the Constitution. The Supreme Court, in this composition, ruled that European law is more important than the Polish Constitution. Through this ruling, the Supreme Court is attempting to cede part of Poland's sovereignty

- We must begin by stating that Supreme Court rulings are not binding in themselves. They are binding in individual cases. This particular ruling was in an individual case. However, it is very often the case that other judges in Poland look at the Supreme Court's line of jurisprudence and adapt to it. This is not an interpretation. This is a response to the fact that the Supreme Court has indeed acted against the Constitution. The Supreme Court, in this composition, ruled that European law is more important than the Polish Constitution. Through this ruling, the Supreme Court is attempting to cede part of Poland's sovereignty abroad, de facto to the EU, which is absolutely inadmissible. This was stated by the Constitutional Tribunal in several rulings, at least two, and not under the current leadership, but when Mr. Safjan or Mr. Rzepliński was the President of the Constitutional Tribunal, when opinions were sent to the Constitutional Tribunal by, I don't know, Grzegorz Schetyna as Minister of Foreign Affairs or Bronisław Komorowski or other current opposition leaders, and everyone firmly stood by the position that the Constitution, because it is logical, it even follows from the Constitution, takes precedence over European law – stated Michał Woś in an interview with Beata Michniewicz on "Trójka's Political Salon".

Left-Wing MPs Demand Access to CBA Report on Banaś, Announce Impeachment Motion Against NIK President Today

We want the public to see the CBA report. If Mr. MP Kaczyński and Mr. MP Morawiecki were able to review this report, why shouldn't Ms. MP Zawisza and Mr. MP Trela be allowed to see it? Today we will use our parliamentary rights and demand that this document be handed over. It should not pose any difficulty, as this document has been generated, it exists. We simply want to see it and familiarize ourselves with it. Undoubtedly, the knowledge we acquire will be an element of our motion for a State Tribunal against President Banaś. This motion will be ready today. We want to detail it, supplement it with those essential elements contained in this report” – said Tomasz Trela from The Left during a press conference in front of the Central Anticorruption Bureau headquarters.

10:49

Gasiuk-Pihowicz:

We Appeal to the President to Rectify His Mistake and Submit a Law to Depoliticize the KRS and Rebuild a Judiciary Independent of Political Influence
Following the final rulings of the EU court and the Supreme Court, we appeal to President Duda to rectify his mistake and submit a law that will depoliticize the National Council of the Judiciary (KRS) and rebuild a system of judicial discipline independent of political influence. Today, Andrzej Duda faces a test of his capacity to serve as President. This will be a litmus test to see if he is, to any extent, a president, or merely subordinate to Zbigniew Ziobro, Jarosław Kaczyński, or Mateusz Morawiecki, and whether he prioritizes party loyalty over the interests of the state and its citizens - stated Kamila Gasiuk-Pihowicz at a press briefing. If Andrzej Duda and his superiors in the PiS government do not prepare such a law themselves, one that responds to the rulings of the EU court and the Supreme Court, then in a few weeks we will have a ready draft law for depoliticizing the KRS - the MP emphasized.

11:03

Tomczyk:

It Was a Black Thursday for Polish Democracy

- In reality, it can be said that it was a black Thursday for Polish democracy. Under the cover of night, without photos, without media, without inviting external individuals, President Duda swore in Mr. Piotrowicz and Ms. Pawłowicz. Illegally elected by the Polish Sejm. From this very place, we also wanted to recall the declaration and thank for it, the declaration by Małgorzata Kidawa-Błońska, who said that one of the first decisions would be to address the Sejm with an appeal to recognize this election as invalid, given that Mr. Piotrowicz and Ms. Pawłowicz did not meet the age criteria for election to a judicial office - stated Cezary Tomczyk at a press briefing.

11:27

Poncyliusz:

Kaczyński May Have Hoped to Keep Judges Under His Thumb, But It Has Now Spilled Over

“The problem is that over the last 4 years, the political world has begun to manipulate the constitution, the entire legislation, the entire legal order in Poland, so much so that in my opinion, everything has now spilled over. Zbigniew Ziobro and Jarosław Kaczyński were aware of this. Perhaps he counted on being able to keep judges under his thumb, along with those who do not align with what the PiS authorities desire, but now it has spilled over. Give a horse to anyone who can solve this now” - said Paweł Poncyliusz from Civic Coalition in a conversation with Jacek Prusinowski on Radio Plus's "Sedno Sprawy" (The Heart of the Matter).

11:32

Poncyljusz:

A Round Table is Needed Today to Outline Our Vision for the Legal System, Including the Discipline of Judges

“President Duda should really sit down at some point. It might be a matter of talking with the Speakers of the Sejm and Senate, and the leaders of political parties. In my opinion, this has already spun out of anyone’s control and will end with citizens completely losing faith in the legal order,” said Paweł Poncyljusz of Civic Coalition in a conversation with Jacek Prusinowski in Radio Plus’s “Sedno Sprawy.”

“Within the opposition, there are opinions that not everything in the judicial system before 2015 was ideal. The question is whether decisions are made faster after four years. Such a round table is needed today to outline our vision for the legal system, also in terms of disciplining judges who, at the district court level, are bad people,” he added.

Polish PM and Merkel Pay Tribute to Victims of German Nazi Concentration and Extermination Camp Auschwitz at the Wall of Execution

The Prime Minister of the Republic of Poland, Mateusz Morawiecki, along with German Chancellor Angela Merkel, paid tribute to the victims of the German Nazi concentration and extermination camp Auschwitz-Birkenau at the Memorial Wall. The Wall of Execution is a symbolic place where prisoners were executed.

The visit was a significant moment, underscoring the shared responsibility for remembrance and the importance of never forgetting the atrocities committed during World War II. The commemorations at Auschwitz serve as a powerful reminder of the horrors of the Holocaust and the need for vigilance against hatred and intolerance.

The Polish Prime Minister's office and the Auschwitz-Birkenau State Museum shared updates and reflections on the solemn occasion:

Borys:

We've submitted a motion for the government to present information at the next Sejm session regarding the services' inaction concerning Banaś. If this information isn't obtained, we will file a motion of no confidence against Kamiński.

- We have submitted a motion for the government to present full information at the next Sejm session concerning the services' inaction in the investigation of Marian Banaś, both when he was the head of KAS, the Minister of Finance, and the President of the Supreme Audit Office. We demand this information. Following yesterday's announcement by Marshal Schetyna, we will submit it. In the event that this information is not obtained, we will file a motion of no confidence against Minister Mariusz Kamiński. This will happen immediately after we do not receive assurances of full information at the next Sejm session - stated Piotr Borys at a press briefing in the Sejm.

13:59

PM in Auschwitz: 'If Memory Fades, It's as if We've Wronged Those Who Suffered Here a Second Time. Today, We Must Cherish Memory as We Would Cherish Those People'
"If memory fades, it's as if we've wronged those who went through hell here, unimaginable suffering, a second time. Emmanuel Levinas said that a lack of memory, forgetting, is like once again giving the victory to evil over good. So, today we must cherish memory as we would cherish those people. That's all we can do for them. In this regard, we strive to care for all such places of remembrance" - stated Prime Minister Mateusz Morawiecki during the official part of the 10th-anniversary ceremony of the Auschwitz-Birkenau Foundation. "Zofia Kossak-Szczucka said that one who is passive in the face of evil is as if a participant in evil. Today, we can say about ourselves that one who is passive in the face of historical falsehoods is as if a co-author of those falsehoods. Therefore, today we must all cherish the truth of those times with the utmost care" - PMM continued to say.

14:10

PMM:

Justice for Victims Requires Remembrance, Reparation is Part of Justice

- The Polish state commits to caring for the memory of those times, for the memory of Nazi Germany's crimes, and I want to emphasize that justice delayed for victims requires this remembrance, and at the same time, reparation towards those who are alive and those who are no longer with us, but towards those to whom we owe remembrance, is also an element of this justice, which we will strive for - stated Prime Minister Mateusz Morawiecki during the official part of the 10th anniversary ceremony of the Auschwitz-Birkenau Foundation.

14:16

Merkel at Auschwitz: I feel deep shame for the barbaric crimes committed by Germans. Crimes that defy imagination.
"It is not easy for me to stand here today and speak to you as Federal Chancellor. I feel deep shame for the barbaric crimes committed by Germans. Crimes that defy imagination. One should actually fall silent in horror in the face of what was done to women, children, and men in this place. What words can convey the pain for all the people who were humiliated, tortured, and murdered here?" - said German Chancellor Angela Merkel at the former Nazi concentration camp Auschwitz-Birkenau.

19:54

Nowicka:

I can declare on behalf of The Left. We don't want the Banasiowa Republic to continue. It should end

- I can say, declare on behalf of The Left. We do not want the Banasiowa Republic to continue. We do not want a situation where the worse it gets, the better it is. It should end, but primarily not through changing the constitution, but through the use of existing legal instruments – said Wanda Nowicka in a conversation with Piotr Witwicki on the program "Events and Opinions" on Polsat News.

19:56

Nowicka on Kulasek's Statement Regarding MP's Earnings: I Apologize on Behalf of the Left Club for Such Words Being Spoken. They are Completely Inappropriate and Untrue
- Those were very unfortunate words. He certainly claims, and it certainly happened, I have no reason to doubt, that they were not authorized. I don't know the context, I haven't followed this matter. But I can also say that I apologize on behalf of the Left club for such words being spoken, because they are completely inappropriate and untrue - said Wanda Nowicka in an interview with Piotr Witwicki on the program "Wydarzenia i Opinie" on Polsat News.

20:01

Jaworski on the Banaś Case: Let's Not Talk About Changing the Constitution, Because It's Not a Good Idea. It's a Sacred Law, Let It Remain Sacred
One of the cases is the Tribunal of State. Here, unfortunately, I must say that, as you noticed, Mr. Editor, there are currently no legal grounds to apply this instrument. On the other hand, there is court proceedings and a relevant, legally binding ruling, and a prosecutor's motion. And these mechanisms must be utilized. Let's not talk about changing the constitution, because it's not a good idea. The constitution has been the same from the very beginning, only amendments are introduced to it. It is a sacred law, let it remain sacred - said Lech Jaworski in an interview with Piotr Witwicki on the program "Wydarzenia i Opinie" (Events and Opinions) on Polsat News.

20:14

Hermeliński on Ast's statement that the Supreme Court ruling is an "opinion": These are things that compromise lawyers

- Mr. Ast here hasn't strayed far from what was said a few years ago about rulings of the Constitutional Tribunal. These are opinions issued over coffee and cakes. Honestly, when I hear these opinions, I can't listen to them because these are things that compromise lawyers - said Wojciech Hermeliński in an interview with Piotr Marciniak on "Fakty po faktach" TVN24.

Hermeliński:

Mr. Kanthak Said Yesterday That the Legitimacy of Luxembourg Court Judges Could Be Challenged. These Are Also Compromising Matters

- I heard Mr. Kanthak say yesterday, I believe on your show, that the legitimacy of the Luxembourg court judges could be challenged. This is how we will play this game endlessly. What Mr. Kanthak is saying, forgive me, is also compromising, because it has no bearing on the ruling of the Luxembourg court concerning the Constitutional Tribunal. These are two separate realms – said Wojciech Hermeliński in a conversation with Piotr Marciniak on TVN24's "Fakty po faktach".

20:25

Hermeliński on Pawłowicz and Piotrowicz: The Principle of Unimpeachable Character is Not Met

- I have always maintained that this principle of unimpeachable character is not met. If we consider the conduct, the statements of Mr. Piotrowicz, who spoke of these thieving judges, and a lawsuit is currently underway in this matter, or Ms. Pawłowicz – said Wojciech Hermeliński in an interview with Piotr Marciniak on TVN24's „Fakty po faktach”.

- Unfortunately, it is sad to repeat, but Ms. Pawłowicz's behavior during parliamentary committee hearings is not the kind of behavior that should characterize a judge of the tribunal, any judge – Hermeliński added.
