The procedure under Article 7 will still continue, but it will concern other elements of the legal system. There would not have been such a turnout among the opponents of the ruling party if it weren't for Ziobro's completely ill-conceived motion to the Constitutional Tribunal to check the compliance of the Treaty on European Union with the Polish constitution, which sabotaged his own camp's campaign. The next two election campaigns – for the European and Polish parliaments – were also supposed to turn into a referendum on Poland's future in the EU. If Morawiecki returns to the European stage, such a narrative will not make much sense. The opposition, celebrating that PiS seems to be backing down from the demolition of the Supreme Court, should already be thinking about what else they want to offer Poles in a year. The question is whether the Commission will withdraw the complaint? Because there is no certainty that PiS – when, for example, it wins the next elections – will return to its ideas of removing judges from courts of any instance by shortening retirement age or introducing other regulations – such as a limit on years of service. The Commission may consider it in the interest of the Union for the Court to define the standards for maintaining the principle of the right to an impartial court. If the Commission withdraws the complaint, it will give PiS the opportunity to save face with its own voters who may be disappointed that they have not 'cleansed' the Supreme Court.”

-- PIS HAS RETREATED CLEVERLY - SIEDLECKA CONTINUES: “PiS has retreated. But cleverly. It will not 'recapture' the Supreme Court, but it has created two chambers there through which it can still achieve the goals it set for itself: control jurisprudence in electoral and other public cases, eliminate disobedient judges from the profession, intimidate them. The elimination of 'old' judges of the Supreme Court or the Supreme Administrative Court was not necessary at all. It was rather, characteristic of PiS, an element of revenge and a propagandistically won slogan of 'purification' from alleged 'judges of martial law.' A primarily symbolic action.
