Undermining Prosecutors' Right to Independent Decisions: Korneluk Issues a Statement

- In connection with statements appearing in the public sphere and positions presented, which in the assessment of prosecutors should be interpreted as undermining the right of prosecutors to make independent decisions, and thus questioning one of the cornerstones of the prosecution service's functioning in a democratic state governed by the rule of law, I express my strong opposition to such attitudes - wrote Dariusz Korneluk in a statement.

"Since taking office as National Prosecutor, in cooperation with the Prosecutor General, I have consistently strived to rebuild a prosecution service that operates independently, professionally, and free from political influences and media expectations.

I am fully aware that the experiences of recent years have shaped the public's perception of the prosecution service as an institution acting under the influence of political factors. Restoring the standards of the rule of law and rebuilding citizens' trust in the prosecution service as an independent body, acting solely for the protection of legality and the public interest, requires time, consistency, and the joint effort of the entire prosecutorial community.

I am undertaking these actions together with prosecutors who, through their years of service, have proven that they understand the essence of an independent and lawful prosecution service. Regardless of the assessments made of us, including unjustified ones, we will consistently pursue this direction of change. I also count on the creation of appropriate legal frameworks for separating the functions of the Minister of Justice and the Prosecutor General, which has been an unfulfilled expectation of legal circles, including prosecutors, for years, and is one of the key elements guaranteeing the autonomy of the prosecution service."

- While respecting the right to assess and criticize decisions made by prosecutors, I appeal, especially to individuals and institutions professionally involved in the application of law, to exercise prudence when formulating public opinions. It is unacceptable to personally attack a prosecutor solely because of the content of a decision made by them, especially when legal remedies are available for procedural decisions, ensuring their review by an independent court - wrote Korneluk.
