Bogucki Suggests Possible Challenge of Government Resolution in Constitutional Tribunal:

De Facto Circumventing the Law.

- Today I participated in a Council of Ministers meeting, as the extraordinary session concerned state security and defense matters. As the President's representative and by the President's order, I took part in this meeting - stated Zbigniew Bogucki at a press conference.

- The Council of Ministers, as indeed it announced, adopted a resolution concerning the de facto circumventing of the law, because that is what it must be called, due to the President's veto. The Council of Ministers wants to implement the SAFE program this time by resolution. In my assessment, this is unacceptable, and of course, it will be thoroughly analyzed from a constitutional perspective - he continued.

- Undoubtedly, this resolution contains norms of an abstract and general nature, and therefore norms of a normative character, and as such, it should be examined by the Constitutional Tribunal. Ultimately, it is the President's decision, but after this initial familiarization with the resolution, I can state that it essentially repeats all those errors and all the constitutional objections that were addressed towards the SAFE act can be leveled against it, and even strengthened - emphasized the Head of the Chancellery of the President.
