The National Prosecutor's Office has reported on three cases on its website.
Indictment Against Macierewicz
"On December 15, 2025, a prosecutor from Investigation Team No. 4 of the National Prosecutor's Office filed an indictment with the District Court in Warsaw against Antoni Macierewicz, a Member of the Sejm of the Republic of Poland and former Minister of National Defence" - reads the prosecution's website.
The former Minister of National Defence has been accused of, as a public official, disclosing classified information, including details marked "strictly confidential," "confidential," "restricted," and "for authorized use," concerning the circumstances of the Tu-154 aircraft crash in Smolensk.
"This act, cumulatively qualified under Article 265 § 1 of the Penal Code and Article 266 § 1 and § 2 of the Penal Code, is punishable by imprisonment for up to 5 years. The justification for the indictment is entirely classified" - the prosecution states.
Investigation into Tu-154M Halted
"A prosecutor from Investigation Team No. 4 has halted the investigation under reference number 1001-13.Ds.7.2024 concerning the exceeding of powers by members of the Subcommittee for the Re-examination of the Aviation Accident of April 10, 2010, including its Chairman, by destroying the Tu-154M aircraft no. 102 [...]; and the failure to fulfill duties by the Minister of National Defence, by neglecting actions to prevent the destruction of the Tu-154M aircraft no. 102 [...]" - reads the prosecution's announcement.
As reported by the prosecution, the proceedings were discontinued due to the absence of elements constituting a prohibited act. The prosecutor ruled that the members of the so-called Smolensk subcommittee did not exceed their authority: they had the right to conduct technical research, the aircraft was already decommissioned before the commencement of work, and the actions taken by the subcommittee were not motivated by an intent to cause harm or obstruct criminal proceedings.
Charges Against Former Head of CBA
"On December 17, 2025, a prosecutor from Investigation Team No. 3 of the National Prosecutor's Office presented Ernest B., the former Head of the Central Anticorruption Bureau, with charges of neglecting official duties in connection with the approval and use of the Pegasus IT system" - informs the prosecution.
"The charges concern the failure to fulfill, between September 2017 and February 2020, duties defined in the Act on the Protection of Classified Information and the Act on the CBA. The neglect of these duties involved the approval and subsequent use of an IT system containing Pegasus software for processing classified information obtained through operational controls, despite the fact that this system lacked the required IT security accreditation" - claims the prosecution.
As reported by the prosecution, Ernest B., interrogated as a suspect, pleaded not guilty to the charges brought against him and refused to provide explanations. The offense with which the former head of the CBA is charged is punishable by imprisonment for up to three years.
