"Violation of the Polish Constitution'. Żurek on the President's Decision

- There is no automatism here. That is to say, if the president refused someone a nomination, there is no automatism for returning from delegation to a lower-level unit. This is a group of judges who aspired to the court of appeal and the district court. So, paradoxically, one could say that by refusing nominations, the president did not increase the number of so-called neo-judges, because these were all individuals who had gone through the competition process before the neo-KRS, – stated Waldemar Żurek at a press briefing in Poznań.

- This is a completely unconstitutional and extra-statutory premise. I can state with full responsibility that this type of approach to the nomination process is a violation of the Polish Constitution. Two constitutional bodies, the KRS and the president, must cooperate with each other, but there is nothing in this system that the president wants to push through in some way, that he alone has the decisive voice on who will become a judge in Poland, – the Minister of Justice continued.
