Żurek Announces Recourse Claims Against So-Called Neo-Judges:
I am consistent in my actions.
- Concrete talks are already underway with representatives of the State Treasury Solicitor's Office [...], regarding the real possibilities of filing so-called recourse claims against individuals who are so-called neo-judges in the Supreme Court. Here we have a simple situation: someone received their title through a flawed procedure, and for European courts, our courts, or even legal Supreme Court judges, they are not a court. They do not constitute a court. Yet they continue to receive remuneration, they still wear their robes, they enter the courtroom, and we pay for their mere presence, - said Waldemar Żurek at a press conference.
As he explained: - If a public official, or indeed any other person, through their own fault causes damage, then the one who paid for that damage has the right to seek recovery of those funds through so-called recourse. Therefore, for me, it is a completely unacceptable situation when the state budget [...] has to pay compensation for ECtHR judgments, merely for their participation in courtroom proceedings.
- These are excellent lawyers; they know that their actions will lead to compensation. Today, they can no longer claim ignorance, because we have well-established jurisprudence that is binding upon us, - he noted.
- So I would like to initiate this procedure, and I would also like to ask these individuals, to appeal to their legal consciences, to truly reconsider their actions, because I am quite consistent in these efforts and I will initiate such recourse claims, - declared the Minister of Justice.
