Cenckiewicz Lacks Classified Access – Security Clearance Not a Judicial Decision

- Of course, it's not the court that decides, and there has never been such a practice, even during PiS rule, that a court ruling determines access. Leaving aside the fact that the judgment is non-final, that a cassation appeal has been filed, so there's still a long way to go to a legally binding court judgment, but it's not the court that decides - he continued.

- The court points out errors made by the service, and that is the nature of this judgment; however, the court does not automatically reinstate such clearances. If we were to adopt such a principle, it would be extremely dangerous for state security - he went on.

- It is very clearly stated in the Act on the Protection of Classified Information that the protection of classified information takes precedence over other regulations, including administrative proceedings in this case, so lawyers have no doubts - he added.

- The court supervises, but the court does not decide who holds a security clearance - he pointed out.

- The service grants the clearance and, of course, respects the court's judgment, and will likely have to restart the procedure in such a case. Furthermore, in the case of the Head of the National Security Bureau (BBN), we have a situation of accusations of disclosing classified information, which would automatically revoke any potential clearance if he were to apply for one - he stated.
