Bodnar on Proposals for Forceful Solutions to Justice System Problems:

I Am Unable to Agree to That.

- Yes, there were complaints. In fact, I think that if I were to look at my entire term in office, from December 13th, there wasn't a single day without some form of complaint, right? But let's look at how it played out. The act on the National Council of the Judiciary was passed. Unfortunately, it was sent by the President to the Constitutional Tribunal. The act on the Constitutional Tribunal was also passed. In a sense, the negative impact on the Constitutional Tribunal, on our public life, was eliminated by adopting a resolution of the Sejm, which defines the status of the Tribunal. As for the National Council of the Judiciary, what I could do was to suspend the nomination process, for which I am responsible - stated Adam Bodnar in the program "Fakty po faktach" on TVN24, when asked about accusations of slow changes in the justice system. - In no ruling of any tribunal, any international tribunal, be it the Court of Justice of the European Union or the European Court of Human Rights, is it written that the repair of the Polish state system can consist of any acts of violence - he continued. - For me, all these calls, I am surprised that yesterday Professor Zoll also went in this direction, towards some non-standard, atypical actions, but also actions that appeared in the statements of some judges on the basis of: we need to cut the power, right, we need to not let them in here. I am generally surprised that judges use this type of language, because either we are building a state in which changes are carried out at the legal level, at the level of solving specific problems, reaching agreements and seeking optimal legal solutions, or we are heading towards the use of the state's coercive apparatus. I am unable to agree to that, and therefore, but I have also clearly articulated this - he emphasized. - I said clearly: listen, that's why an act is needed, an act needs to be passed. And I still believe, I haven't changed my mind, that what needs to be done is to bring about the adoption of an act on the National Council of the Judiciary, i.e., to improve the act that was sent to the Constitutional Tribunal, and to do everything in our power to convince President Nawrocki to sign such an act. Why? Because from May 2026, the term of office or the period of service for those currently sitting on the neo-KRS will end. And it is absolutely fundamental to move forward, because the courts, especially in higher instances, desperately need new judges, whose status is beyond doubt - he added.
