Bodnar Sends Letter to Hołownia Regarding Election Validity:

All Irregularities and Legal Doubts.

- Due to the significance of the presidential election and the constitutional right to an electoral protest, as previously announced, I have today informed the Marshal of the Sejm of the Republic of Poland of all irregularities and legal doubts that occurred during the procedure for reviewing electoral protests and determining the validity of the presidential election – wrote Adam Bodnar on the X portal. Among the aforementioned irregularities and legal doubts, the Prosecutor General listed, among others:
the issuance of a resolution on the validity of the presidential election by the Chamber of Extraordinary Control and Public Affairs of the Supreme Court, which – in light of the Constitution of the Republic of Poland and European Union law – cannot be considered a court, the lack of substantive review of the Prosecutor General’s motions to recuse judges of the Chamber of Extraordinary Control and Public Affairs from adjudicating electoral protest cases, [...] the adoption by the Chamber of Extraordinary Control and Public Affairs of the Supreme Court of a resolution on the validity of the presidential election without reviewing and addressing all submitted electoral protests (providing specific examples), [...] preventing the Prosecutor General from reviewing case files concerning electoral protests within a reasonable time, which violates Article 96a of the Act on the Supreme Court (Journal of Laws of April 23, 2024, item 622), the grouping of electoral protests contrary to the principles set forth in § 24 sec. 1 of Ordinance No. 92/2022 of the First President of the Supreme Court of July 15, 2022 [...] the unlawful (contrary to the Act on the Supreme Court and the Rules of the Supreme Court) removal of two judges of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court from adjudicating electoral protest cases.
