A Judge's Prior Case Against Ziobro Does Not Affect Her Ability to Impartially Judge the Justice Fund Case
– The Random Case Assignment System works in such a way that Judge [Justyna Koska-Janusz] was randomly assigned to this case, and that's that. […] This is about, as I understand it, the ordinary adjudication of the Justice Fund case. She is one of the judges at the District Court in Warsaw – said Adam Bodnar in an interview with Dominika Wielowieyska on TOK FM Morning.
– The judge did indeed win the case [against Zbigniew Ziobro concerning the violation of personal rights], and I had to apologize to the judge on behalf of the Ministry of Justice, because that verdict became legally binding only after Zbigniew Ziobro was no longer in office – he pointed out.
– Despite everything, even if it concerns the Justice Fund, I have the impression that the fact she had this dispute with Zbigniew Ziobro in no way affects her ability to independently judge the case, which concerns 6 people and is very thoroughly and properly documented – he assessed.
As he stated: – I might approach this in a way that I wouldn't apply the philosophy of action that Minister Ziobro tries to instill in us, that he sees suspicion and conspiracies everywhere. I think that true judges are very principled in their assessment of various situations. However, here, of course, in accordance with the Code of Criminal Procedure, there is the possibility to file a motion to disqualify a judge, and this, according to procedure, is referred to another panel which then adjudicates it.
