Nawrocki on the Incidental Act:
It Violates the Separation of Powers.
– It is terrifying that the rules of the game are being changed four months before the most important elections in Poland, certainly in this part of Europe, the presidential elections. This shows a very disturbing trend in the Polish judiciary, it only deepens further chaos in the justice system – said Karol Nawrocki on TV Republika when asked about the incidental act.
– This fundamentally violates the separation of powers in a deeper legal sense, because it is the legislative branch that designates specific judges to resolve a specific case. This does not sound like it would happen in a democratic state – he continued.

– The fact that it will be 15 judges with the longest tenure already sparks my imagination […] if it is 15 judges with the longest tenure who will decide, and I am elected President of the Republic of Poland, then the regularity of these elections will be decided by 15 judges, most likely those who were appointed by the Council of State during the Martial Law period or the 1980s – he went on to say.
– I do not know their biographies and I have not analyzed them […] but those who were in fact appointed by the Council of State, a communist body from before 1989, will have to rule, and they will have to rule that the President of the Republic has become the President of the Institute of National Remembrance – he added.
