Laskowski on Ziobro's Request to the Constitutional Tribunal: "It's Evident That Conviction in Common EU Values is Rather Weak." Minister Plays Games with Polish Courts, While This Move Preempts a CJEU Decision.

The Minister has the right to use various legal means, to address the Constitutional Tribunal. Nobody intends to take away this right from him, however, such a request, with a question formulated in this way, raises some concern. It means that the conviction regarding common values binding in the European Union, regarding a common legal order, is rather weak in the author of the request, and perhaps it is a broader phenomenon. It is not a strong conviction, and this is one of the fundamental elements of the European Union” - said the spokesperson for the Supreme Court, Michał Laskowski, at a briefing.


It is evident that the conviction in common values is rather weak when this type of request is submitted. One could say that in a sense, this is another example of instrumental treatment of law, of legal means, and this using the Constitutional Tribunal. The Minister, on the one hand, enters into a kind of game with Polish courts, including the Supreme Court, which formulated such questions, and on the other hand, a kind of game, preemptive moves in relation to potential decisions of the CJEU” - he added.
