Ziobro and Warchoł Announce Criminal Complaint Against Żurek

The subject of today's conference is the filing of a criminal complaint against the Minister of Justice, Waldemar Żurek, who dismissed 47 presidents and vice-presidents of courts without following the proper procedure. This procedure requires the participation of judicial councils. Meanwhile, Minister Żurek, violating these legal provisions in force in our country, is dismissing presidents and vice-presidents according to his own political whim. No one can be punished for adhering to the binding law. Judges and presidents assume and have assumed their positions in the judiciary based on the law – stated Marcin Warchoł at a PiS press conference.

Let me remind you, Article 187, paragraph 4 of the Constitution states that the manner of appointing judges to the National Council of the Judiciary, its mode of operation, scope, and structure are defined by law. And it was on the basis and within the limits of this law that appointments to these positions of court presidents were made. It was also on the basis of this law that judges were elected to the National Council of the Judiciary by parliament, which reflects the will of the nation as the sovereign, because supreme power belongs to the nation, not to judges – he continued.

And what is Minister Żurek doing? He comes out and says that the state will pay compensation, and then seek recourse from them. Well, this is an unimaginable scandal, ladies and gentlemen. The state will pay compensation to those presidents who were recently dismissed by Minister Żurek. Why? Because if the state established certain rules of conduct, and they accepted these positions in trust of those rules, and today they are being deprived of these positions by the very same state, merely because the political power has changed, well, then these are, ladies and gentlemen, dishonest methods of play – concluded Warchoł.
