A statement from Małgorzata Manowska has been published on the Supreme Court's website. The First President of the Supreme Court addressed a resolution adopted by the government last week “on counteracting the negative effects of the constitutional crisis in the area of the judiciary.”

“By virtue of this resolution, in the Journal of Laws for 2024, a peculiar preamble has been added to the entries under which the Supreme Court’s resolutions of September 3, 2024, confirming the validity of elections to the European Parliament […] and to the Senate of the Republic of Poland […] were published, a preamble that undermines the authority of the Supreme Court,” Manowska writes.

As she stated, this maneuver violates “the provisions of the Electoral Code and the Act on the Promulgation of Normative Acts and Certain Other Legal Acts, constituting an unlawful interference in the content of the Supreme Court’s resolution.”

“Hybrid Disinformation Practices.” Manowska Criticizes Bodnar
In the further part of the communication, Małgorzata Manowska referred to Adam Bodnar. She assessed that the Minister of Justice “takes the lead” in questioning the provisions of the act establishing the Chamber of Extraordinary Control and Public Affairs, while at the same time “he has repeatedly taken procedural positions” in cases pending before this chamber.

As she emphasized: “Any pronouncements by a politician holding the office of Minister of Justice and Prosecutor General, claiming that the Chamber of Extraordinary Control and Public Affairs does not exist or is not a court, should be considered examples of hybrid disinformation practices weakening the Republic of Poland and undermining citizens' trust in state institutions, practices which should meet with an adequate response from the bodies responsible for state security.”

At the same time, the First President of the Supreme Court informed that she would not file a notification to the prosecutor's office. “The current political situation does not allow for hope that such a notification could lead to adequate action by this office,” she stated.
