"A Judge Entered the Field and is Playing for One of the Teams": Hołownia on the Constitutional Tribunal Situation and Possible Solutions

- Why are we talking about a constitutional crisis in the title of this meeting? For a simple reason. Law and Justice (PiS) has led to a situation where we have no certainty whether the Supreme Court in its many manifestations, or the Constitutional Tribunal, are the bodies we read about in the Constitution of the Republic of Poland. Whether they truly fulfill the role that the Constitution has written for them, has designated for them - said Szymon Hołownia during the meeting "Ways Out of the Constitutional Crisis". - We must restore the rule of law in Poland in a tough, clear, and simple manner, without equivocation, and restore a sense of security to the citizens of the Republic. [...] Today, a judge has entered the field and is playing for one of the teams; this is the state we are dealing with today when it comes to constitutional judicature - he continued. "We would like to hear what to do: acknowledge the Constitutional Tribunal and inject fresh blood into it, or perhaps decide that this tribunal should expire" - I know that authority is destroyed very quickly and rebuilt over decades, but somewhere this journey must begin. And therefore, today we would like [...] to hear from you what to do, how to proceed, how to move forward in a situation where the terms of three judges of the Constitutional Tribunal and one substitute judge expire in the coming months. How should we proceed: acknowledge the tribunal and inject fresh blood into it [...] or perhaps decide that this tribunal in its current form should expire, so that it can be rebuilt from scratch later - the Marshal of the Sejm continued. - For intellectual honesty, we should put all options on the table before we responsibly decide to choose one of them - he added.
