President Duda: The Constitution Should Explicitly Prohibit Same-Sex Couples from Adopting Children. I Will Present a Constitutional Amendment Proposal on Monday.

- I have decided that the constitutional norms concerning child protection require refinement in one aspect. A child is subject to special protection, and this is unequivocally determined by the provisions of Article 72 of the Constitution. A child is also protected by the state. This protection is particular when parents are deprived of parental authority, when, in short, this parental authority in some sense passes to the Polish state, and it is the Polish state that is responsible for how this parental authority is exercised, because the child is then fully under the care of the Polish state - stated President Andrzej Duda.

. These are children who may be subject to adoption, if they can also be subject to adoption. And here, one doubt could be raised. Because while our law states that marriage is a union of a woman and a man, so if spouses wish to adopt a child, or as some prefer, adopt a child, there is no problem here. There is no fear that the marriage will be same-sex, because the Polish Constitution unequivocally excludes this, but other cases are possible, which is why I believe that the Polish Constitution should explicitly contain a provision stating that the adoption of a child or fostering by a person in a same-sex relationship is excluded - he continued.

- For the child's safety, for their proper upbringing, for the Polish state to safeguard the child's rights and protect the child's welfare, such a provision should exist in my opinion, and at this moment it is the state's responsibility to whom it entrusts the child for upbringing, and therefore I have decided to propose to parliamentarians the introduction of such a provision. On Monday, I will sign the appropriate document along with the legislative proposal, i.e., the presidential draft amendment to the Constitution, which will be submitted to the Polish Sejm - PAD emphasized.
