Łapiński: President Duda has never violated the Constitution. The issue of the State Tribunal does not concern him - The President believes this based on the Constitution [that the Supreme Court ruling is invalid by operation of law], which states that all state organs operate within the limits and on the basis of law - said Krzysztof Szczerski at a press conference at the Presidential Palace. - State organs operate on the basis and within the limits. If someone exceeds these, there is no prohibition against acting beyond the limits of the law, because there is a mandate to act within the limits of the law. There is no legal provision prohibiting action outside the law, because there is a mandate to act within the framework of the law - added the Head of the President's Office.
- One can ask another question: on the basis of which articles is the Supreme Court taking such positions in a case between ZUS and a private individual, in a case that does not concern the president, the Chancellery of the President, or the National Council of the Judiciary at all. Even recently, in various newspapers, there were articles, also statements from constitutionalists, who said that for the first time such a construction from the Code of Civil Procedure was used, which generally refers to other situations - stated Krzysztof Łapiński in turn.
- As a spokesperson, I can answer that the role of a spokesperson, probably of any, is verbal restraint and calmly explaining the decisions or intentions of their boss or institution, and rather not such political digressions. The President, as you know, has never violated the Constitution in any way. Regarding the issue of the State Tribunal, this matter does not concern him in any way - added the President's spokesperson, referring to the words of the Supreme Court spokesperson.
